BAIER: “Shannon, a “New York Times” columnist Ezra Klein on x posted these two stories together: we are not enforcing the TikTok ban that we signed into law but we are unilaterally declaring the Equal Right Amendments ratified is an odd final play for the Biden Administration. This era equal rights amendment deal that is suddenly part of the Constitution doesn’t seem like it’s going to last long.”
BREAM: “Yeah there are plenty of legal scholars other than the ones that President Biden consulted who says no this has no legal effect for you to say this. Congress has said in the 1979 deadline, they didn’t get enough states, there was a play that extend that to 1982. That got caught up in some legal action too. But even by then, they didn’t have all the states they needed. You heard the archivist just three weeks ago telling the White House this doesn’t count, you don’t get to make this an amendment, we will not recognize it, citing the Justice Department including under President Biden. But there is also a conversation to remember that the late Justice Ginsburg who fought for women’s rights and the era said no, they didn’t get it done in the right framework, you have you got to start this over again. It’s just not legit.”
