SENATE TRIAL OF CITIZEN TRUMP IS UNCONSTITUTIONAL
Can the Democrats have an impeachment trial against a former President after he has left office and is no longer President.
I have heard legal pundits on cable news say that this is an open or undecided question.
They give no satisfactory explanation why it would be an open question.
Let’s look at the U. S. Constitution for an answer.
“The Senate shall have the sole Power to try all Impeachments” Art. I, sec. 2, cl. 6).
“The President, Vice President and all civil Officers … shall be removed from Office on Impeachment for, and Conviction of Treason, Bribery, or other high Crimes and Misdemeanors” (Art. 2, sec. 4).
“… shall be removed from Office on Impeachment for, and Conviction …”
The words of the Constitution are specific.
“The President ….”
It does not say the former President.
