Byron York: ‘Judge Merchan Appears to Be Wanting to Sentence Trump But Not to Any Jail’

MELUGIN: “So look, when it comes to this at trial, the American public got to see this thing play out every day. Every network was covering the details live every minute, every hour. They got to see the facts of the case for the still-elected Donald Trump and he swept every single battleground state. What does that say to you?”
YORK: “You have just given Donald Trump’s latest and most powerful argument to throw this whole thing out. Basically what Trump is saying now is Judge Merchan who is a county judge in a state does not have the authority to burden and sentence the president of the United States. It does not work that way. You just heard Greg Gertt say formally, legally Trump needs to be sentenced to be formerly known as a convicted felon. There are a couple of possibilities. Trump wants to throw the whole thing out, the prosecutors originally said Why Don’t We just delay this sentencing until after Trump is president in 2029? In that way, it will be hanging over his head the whole time he is president of the United States, that was kind of a crazy idea. And now Judge Merchan appears to be wanting to sentence Trump but not to any jail or any actual punishment but still have that sentencing in place so Trump can be called a convicted felon.”
