Was the Vaccine Mandate Constitutional? The legality of vaccine mandates is based on an old case from 1905 case, Jacobson v Commonwealth of Massachusetts. . The Jackson court established that it is within the police power of a state to provide for compulsory vaccination. The Supreme Court in Jacobson upheld the constitutionality of a state compulsory vaccination law enacted to combat a smallpox outbreak. . The Court found that the vaccine mandate was rational in “protect[ing] the public health and public safety”. However, the Jacobson case does not stand for the proposition that anything goes in mandating vaccines. . Previous Courts’ Application of Jacobson is Wrong In the context of the current pandemic (COVID-19), several courts have applied Jacobson to find that mandatory vaccine policies at state universities and among state executive agency employees meet the rational basis test. . In recent cases, plaintiffs have attempted to distinguish their cases from Jacobson by arguing that the COVID-19 vaccines are not vaccines but are instead “Gene Therapy Products” or that the mandates are not the result of a legislative process . The 9th Circuit today overturned a lower court decision that applied Jacobson. It said this: . Addressing the merits, the panel held that the district court misapplied the Supreme Court’s decision in Jacobson v. Massachusetts, 197 U.S. 11 (1905), in concluding that the Policy survived rational basis review. Jacobson held that mandatory vaccinations were rationally related to preventing the spread of smallpox. Here, however, plaintiffs allege that the vaccine does not effectively prevent spread but only mitigates symptoms for the recipient and therefore is akin to a medical treatment, not a “traditional” vaccine. Taking plaintiffs’ allegations as true at this stage of litigation, plaintiffs plausibly alleged that the COVID-19 vaccine does not effectively “prevent the spread” of COVID-19. This is unequivocal. Therefore, they are beholden to no FDA regulations, and cannot be regulated by the FDA. In a pair of videos released earlier this year, retired pharmaceutical industry R&D executive Sasha Latypova (@sasha_latypova ) describes, in detail—with all “the receipts”—how the C19 injections are, in fact, in a class of their own, so to speak; one NOT REGULATED BY THE FDA. In this first clip from a conversation between Latypova and writer and paralegal Katherine Watt, Latypova explains how there are three regulatory pathways for pharmaceutical drugs, which are “normal regulatory pathways, where we don’t have [an] emergency announcement.” Latypova notes that these pathways include investigational use of the product; FDA-approved drugs; investigational drugs (if you want to introduce a new drug, then you need to clinical trial it across state lines); and drugs made available under “expanded access use.” Expanded access use, Latypova notes, is “a more recent evolution” of regulatory law, which was put into place in 1997. Since then, expanded access use has allowed for the use of experimental drugs in “desperate situations.” The fourth regulatory pathway is the one used for the C19 injections: “EUA countermeasures under [a] public health emergency.” Latypova notes that for an “EUA under public health emergency, none of these normal [FDA regulations] apply [in an enforceable manner].” This is why Latypova and Watt refer to the supposed FDA regulation and approval of the C19 injections as “performance art.” The injections are EUA countermeasures deployed under a public health emergency. Per the law, they cannot be regulated as pharmaceutical drugs. Canadian Comprehensive Physician Dr. Chris Shoemaker (@CShoemakerMD ) describes for Laura-Lynn Tyler Thompson (@LauraLynnTT ) the results of a study performed by Dr. Nakahara Takehiro, et al. at the Keio University School of Medicine in Japan, which found that COVID-"vaccinated" hearts work "twice as hard as [they] should" for "six continuous months" following injection. Shoemaker specifically shows how COVID-"vaccinated" hearts are appearing "blackened" on PET scans, meaning they're experiencing an anomalously high uptake of glucose. The authors of the study "couldn't understand, 'Well, why is the heart showing up black on our studies? The heart never has strange or extra glucose uptake," Shoemaker tells Tyler Thompson. The physician notes how PET (or positron emission tomography) scans of "unvaccinated people" in the images to the left of what's displayed (graphics taken from the study) show "soft, gray" hearts. Conversely, in PET scans of "vaccinated" people on the right, the hearts are "blackened out." The two specific hearts shown in the images, Shoemaker notes, were in two individuals that had a "high-level doubling of the amount of effort" they put out. In one of the hearts, there was 100% elevation and effort. On average, "vaccinated" people had hearts that were working 50 to 60% harder than normal. All 700 of the COVID-"vaccinated" people in the study had some level of elevated cardiac effort. "The dark redness, or the dark blackness, that is a heart that is working...twice as hard as it should...and it does it for six continuous month[s] after two vaccinations," Shoemaker says, referring to the COVID-"vaccinated" hearts shown in the presented study excerpt.
