Vance on The Allegation Against Fani Willis: ‘It Really Won’t’ Endanger Her Case Against Trump

CAPEHART: “So, could this allegation against D.A. Fani Willis endanger her case against Trump?”
Vance: “It really won’t, Jonathan. And this is perhaps a little bit difficult to explain, but there are two separate things going on here. One is the prosecution against Michael Roman, the defendant who has made these allegations, and his co-defendants. And their guilt or innocence is not impacted in any way by these allegations, that case will go on regardless. The question that is posed by the ethics argument Roman has raised is whether Fani Willis can continue on the case. And under Georgia law, she clearly can, although she might need to answer to the county commission, she might have some ethics issues to resolve. The only sort of a situation that would create a conflict of interest that would justify her recusal would be if there was a financial conflict of interest that impacted the fairness of the prosecution. And here, that is not the case. You know, what might that look like if Nathan Wade, the prosecutor that she has hired, if he was only going to be paid if he got a conviction that might be an improper setting. But here where you’ve got two prosecutors, both on the same side, working on a case. This might raise an appearance of impropriety, but it is not an actual conflict of interest that would force her to step down.”
