Man Charged with DUI and Smashes His Truck After His Girlfriend Leaves Him
ROCK ISLAND, IL - At 1:22AM on January 26th, 2020, a Rock Island Police Officer pulled over an erratic driver with significant damage to his truck. The suspect informed the officer that he had just broke up with his girlfriend and had left from the bar after she had left him. When questioned by the officer if he had hit a utility pole nearby, the suspect adamently denied that he had done so, but rather that he had hit a deer two weeks prior. The officer inquired several more times, whereupon the suspect said, "I am not going to lie to you," while reaffirming his story. The suspect later admitted to having "three stouts and one IPA." The suspect was then placed in the officer's vehicle to be transported to the police station to conduct a field sobriety test (FST). The officer then told the suspect that his license plate was found at the scene of the accident and that he did in fact hit the light pole to which the suspect did not reply.
Upon realizing that there was a space in the parking lot that was cleared, the suspect was taken out of the police cruiser to perform the FST. The officer asked the suspect if he had any vision problems that would affect his abilities to perform the horizontal gaze nystagmus test. The suspect claimed to be color blind, but stated that his vision was sufficient enough to do as the officer instructed. During the test, the suspect continually moved his head when tracking the officer's pen and displayed the inability to smoothly follow the object. Nystagmus was observed throughout the exercise with a jerking motion at maximum deviation. The suspect told the officer that he particularly did not like being in cold weather.
The suspect was then placed into the starting position for the walk-and-turn test upon the officer's instruction. Once in position, the suspect attempted the test, but lost balance and had to be instructed to go back into the starting position. The suspect asked for instructions while performing the test and took wide, sweeping steps while performing the exercise. The suspect once again told the officer that he did not like being outside in cold weather. After the officer explained the one-legged balance test to the suspect, he told the suspect to begin. The suspect was unable to balance without swaying, had to be told to look down at his feet, did not count the number 14 correctly, and admitted to losing his balance after counting to the number 21. The suspect apologized and blamed his performance on being frostbitten when he was younger.
The officer arrested the suspect for driving under the influence (DUI) and told him that based off the test he had shown signs of impairment. After informing the suspect that he would take a breathalyzer test at the station, the suspect told the officer that he wanted to perform a preliminary breath test on scene. The suspect told the officer that he appreciated that he had taken the keys out and locked the door of his vehicle because he loved that truck more than he did his life. Following a search of the suspect's person, nothing was found to be illegal in his possession.
At the station, the suspect consented to a breath alcohol sample. The breathalyzer test yielded a result of .160% BrAC. This is twice the legal limit to drive in the State of Illinois.
