Florida Man Arrested for DWI in Upstate New York

GLOVERSVILLE, NY - On February 3rd, 2020 at 8:46PM, Gloversville Police observed a driver taking a turn too wide and failing to return to their lane. A traffic stop was initiated by the officer near a convenience store. Upon making contact with the suspect, the officer noticed a strong odor of alcohol coming from the vehicle. The suspect stated he had four beers and was coming from a friend's house. The suspect was asked to step out of the vehicle and consented to a field sobriety test.

During the horizontal gaze nystagmus test, the suspect was observed having a lack of pursuit and had maximum deviation in both eyes. The suspect was swaying during the exercise. During the walk-and-turn test, the suspect had difficulties touching heel-to-toe and removed himself from the precribed foot placement while the officer demonstrated the test. The suspect had difficulties performing the one-legged balance test and stopped performing after complaining of being unable to do so following a brief attempt.

The suspect consented to a breathalyzer in the field which yielded .14% BrAC. The officer arrested the suspect for driving while intoxicated (DWI). The suspect was read his miranda rights and transported to the station for more processing where the suspect once again blew .14% BrAC at the station.
