OBERLIN, OH - At 4:24PM on January 24th, 2020, Oberlin Police Officers responded to a call of a man parked on the shoulder on the wrong side of the road at the intersection of State Route 58 and US Route 20. As the officer approached the vehicle, he opened the door and began questioning the suspect how he ended up on the shoulder of the opposite side of the road. The officer observed an empty alcoholic beverage in the center console of the suspect's vehicle. The suspect did not why he was parked where he was and admitted to consuming alcoholic beverages. The suspect also stated that he was "between places" and lived, "nowhere."

Once outside the vehicle, the suspect admitted to the officer that he had drank "a handful" of beers. The officer then asked the suspect if he would participate in a field sobriety test, but he declined. In response, the officer arrested the suspect for operating a vehicle under the influence (OVI). While being processed, dispatch alerted the officers on scene that the suspect had a prior OVI conviction back in 2008. Furthermore, the officers received word from the EMT's that the suspect had told them he had just came from a party and was "pretty lit."

Because the suspect had been convicted of OVI in 2008, he was charged with OVI - 1st offense within 10 years. At the station, the suspect refused to provide a breath alcohol sample.
