Washington Gun Law President, William Kirk, discusses what might become a tipping point for many lawful and responsible gun owners in this State under HB 1504, a bill that will require insurance on each firearm that you own and if you don't want to get the insurance, then you can just pay $25,000 per firearm to exercise your right. This is absolutely one of the worst bills from a State that just keeps outdoing itself. So learn more today and arm yourself with education. I had an insurance policy through USCCA and I had it for almost a year and then I was notified by them that they had to cancel my policy because I live in Washington and Washington state would not allow you to own a policy for liability to cover your guns because they called it murder insurance. I do have another company that I have been able to purchase insurance through. When they tell you you have to have insurance, but they don’t allow you to purchase that insurance you’re between a rock and a hard place. This is ridiculous! In the Washington State Constitution under Article 1 Section 2 it states that the constitution of the United States is the supreme law of the land. Article 2 of the US Constitution gives us the right to bear arms. Article 1 Section 24 of the Washington State Constitution says that we have the right to bare arms, it also states that it shall not be impaired. So the state of Washington is violating its own constitution as well as the US Constitution. I implore you, if you’re reading my post, please get in touch with your state representative and your state senators to let them know that this is not OK, and if they go along with this, we’re going to vote them out of office! If you don’t have a Washington state constitution please get them. They’re given away freely at most state fairs, and any function related to guns. It’s time that we show them that we the citizens run this state they are our employees. Washington state put a lot of good small contractors out of business a few years back with an additional $1,000,000.00 per construction job insurance requirement. Again, putting small businesses out of business and their employees out of work. The big companies had no problem. Hopefully, the new president will appoint two, new, strong, attorney's general for the Federal government in Washington State, who can start looking at irregularities in the state for many things, including voters rolls and the use of insurance companies to track and control people's activities for the State of Washington. Washington State Firearm Registration Process. Washington State does not but very soon will require general firearm registration for private individuals. However, there are specific regulations and requirements for certain types of firearms and transactions. Here are the key points regarding firearm registration and related processes in Washington State: Retail Dealers: Retail dealers are required to record and report all retail pistol sales to local police/sheriff and to the State Department of Licensing. This is a form of registration for firearms sold through retail channels. WA Outrage: HB 1504 Would Block Gun Ownership Without Liability Insurance. Already alarmed by several restrictive gun control bills, Washington state gun owners are now outraged over the introduction of House Bill 1504, a measure which would prohibit not just the purchase, but the possession of a firearm unless that gun is “Insured under a firearm liability policy or covered by a firearm liability bond.” It is an idea that has been proposed elsewhere around the country. According to an article in the South Carolina Law Review, “Until recently, no mandate had been enacted. In 2022, San Jose, California, and New Jersey passed laws requiring gun owners to carry liability insurance. But are insurance mandates likely to affect either the incidence of gun violence or the economic burden borne by the government or the victim? And are they likely to escape the courts unscathed?” Second Amendment activists reacted on the Washington 2025 Legislative Action Group’s Facebook page with a mix of anger and contempt, coupled with vows of resistance if/when this proposal becomes law. HB 1504 was introduced by anti-gun-rights Rep. Kristine Reeves, and she is joined by seven other lawmakers—all far-left Democrats associated with other gun control legislation—including Representatives Beth Doglio, Lauren Davis, Julia Reed, Timm Ormsby, Alex Ramel, Gerry Pollet, and My-Linh Thai. Proof of financial responsibility to purchase or possess a firearm must be provided on the request of a dealer or law enforcement officer in the format specified under subsection (5) of this section.” Evergreen State attorney Bill Kirk, president of Washington Gun Law and an authority on firearms laws in the state, was so alarmed by this measure he put together a video alert in which he unabashedly predicted if passed into law, it will be the “tipping point” to drive gun owners out of the state. It is not the first time gun owner insurance has been pushed by Democrats in Olympia. Last year, the idea was proposed by then-State Sen. Patty Kuderer, a Bellevue Democrat who has now become the State Insurance Commissioner. As reported at the time by the Daily Olympian, Kuderer’s bill would have required Washington gun owners to carry liability insurance “to cover the losses or damages resulting from any accidental use of a firearm,” she said at the time. The newspaper reported at the time that more than 1,100 people signed up to oppose the legislation at a hearing, and another 776 people signed up to support it. Opponents included Yakima County Commissioner Amanda McKinney, an outspoken critics of the idea. As critics have observed, this is one more attempt by Democrats to penalize law-abiding gun owners for crimes they don’t commit, and make it financially difficult, if not impossible, to own a gun in the state. Many wonder if that is the underlying motive. According to an article published by Lockton Affinity Outdoor, “If such bills were to become law in the future, gunowners may be required to obtain special insurance coverage. Supporters say the idea is similar to laws requiring owners of automobiles to obtain car insurance.” But wait a minute, gun rights advocates might observe, owning and driving a motor vehicle is a privilege, whereas gun ownership is a fundamental right protected by the U.S. Constitution and most state constitutions. If HB 1504 becomes law, lawsuits are guaranteed. Under the language of HB 1504: “(a) A firearm liability policy or bond under this section must: (i) Be issued by an insurance company or surety company authorized to do business in this state; (ii) provide at least $25,000 of coverage per incident arising from accidental or unintentional discharge of the covered firearm causing injury, death, or property damage; and (iii) identify the specific firearm covered by the policy or bond. (b) Firearm liability policies and bonds must be obtained on a per-firearm basis, with a separate policy or bond required for each distinct firearm.” Translation, each firearm must be individually insured, unless a gun owner chooses to self-insure, a costly option requiring deep pockets. A person who owns several guns would have to get a policy for each one. Making this tougher is the fact that no such insurance policies are currently available in Washington state. For those who self-insure, certificates of deposit would be required and placed with the state Department of Licensing. The certificate would require: “(a) Proof of financial responsibility may be evidenced by a certificate issued by the department of licensing establishing that the person named therein has deposited with the department $25,000 in cash, or securities such as may legally be purchased by savings banks or for trust funds of a market value of $25,000. “(b) Certificates of deposit must be obtained on a per-firearm basis, with a separate certificate required for each distinct firearm.” According to the Centralia Chronicle, HB 1504 “would also require firearm range operators to obtain general liability insurance with at least $1 million of coverage per incident. If an individual owns more than 25 firearms, they would qualify as a self-insurer by obtaining a certificate from the state.” The newspaper also noted, “If an individual relies on a policy rather than self-insuring through the state, they must obtain one for each firearm. According to HB 1504, failure to display proof to law enforcement ‘creates a presumption that the person has not complied’ and is punishable by a class 1 civil infraction.” The Washington Constitution, Article 1, Section 24, states, “The right of the individual citizen to bear arms in defense of himself, or the state, shall not be impaired…” Gun rights activists were already asserting that this year’s list of gun control measures amount to “impairments,” and that was before HB 1504 was introduced. HB 2021: Proposed by Representative Tana Senn, this bill would allow the Washington State Patrol to destroy firearms that were illegally owned or used in crimes. It is still under consideration. SB 5444: Sponsored by Senator Javier Valdez, this bill seeks to expand the list of places where open carry of firearms is prohibited, including zoos, aquariums, transit facilities, and libraries. It is currently being reviewed by relevant committees. HB 1386: This bill proposes an additional 11% excise tax on the sale of all ammunition in the state, on top of existing federal and state taxes. It is scheduled for a hearing on January 21, 2025. These bills reflect ongoing efforts to address gun violence and safety concerns in Washington State. Washington state House Democrat pushes bill requiring liability policy to buy or possess firearms. Under a bill proposed Monday, the legislative majority is pushing to require proof of “financial responsibility” before purchasing or possessing a firearm by requiring certain liability policies. Rep. Kristine Reeves, D-Federal Way, proposed House Bill 1504, which was referred to the Civil Rights & Judiciary Committee on Wednesday. If approved, individuals would have to obtain a firearm liability insurance policy or bond before purchasing or possessing the weapon. According to HB 1504, the liability policy or bond must cover at least $25,000 of coverage per incident in the event of an accidental discharge causing injury, death or property damage. The proposed legislation would also require firearm range operators to obtain general liability insurance with at least $1 million of coverage per incident. If an individual owns more than 25 firearms, they would qualify as a self-insurer by obtaining a certificate from the state. “Proof of financial responsibility may be evidenced by a certificate issued by the department of licensing,” according to the bill, “establishing that the person named therein has deposited with the department $25,000." If an individual relies on a policy rather than self-insuring through the state, they must obtain one for each firearm. According to HB 1504, failure to display proof to law enforcement “creates a presumption that the person has not complied” and is punishable by a class 1 civil infraction. House Bill 1504 would also subject individuals to a class 1 civil infraction if they fail to provide proof of financial responsibility to a dealer when purchasing a firearm. Individuals can provide evidence with a paper copy of the policy or electronically on their phone. “Whenever a person presents a portable electronic device pursuant to this section,” according to the proposal, “that person assumes all liability for any damage to the portable electronic device." The bill does include a provision allowing the courts to dismiss any incurred infractions if the individual provides written evidence that they were in compliance at the time of the incident. Those who knowingly provide false evidence of financial responsibility would be guilty of a misdemeanor under the proposal. While it's unclear how the Department of Licensing would enforce HB 1504, it provides authority for the DOL to adopt its own rules for carrying that out. The Center Square reached out to Reeves for comment on the proposal, but did not receive an immediate response. Rep. Jim Walsh, R-Aberdeen, who serves as the ranking minority member on the House Civil Rights & Judiciary Committee told The Center Square that HB 1504 is unconstitutional. Insurance Commissioner of Washington Patty Kuderer ran her campaign on supporting firearm liability insurance, but Walsh compared it to the Jim Crow era practice of poll taxing. Democrats used the tax at the time to disenfranchise black voters who helped elect them after a successful campaign. Black voters were still able to vote, but only if they paid the tax. Walsh said the same is happening with HB 1504: rich people can buy firearms as they can easily afford the policies, but those without sufficient means would be unable purchase firearms, limiting their ability to defend themselves. Washingtonians voted overwhelmingly in 1922 to repeal the state’s poll tax adopted in 1921. “It's just designed to prevent people from owning firearms,” Walsh told The Center Square. “They're reaching the bottom of their barrel on gun control proposals that are just increasingly flagrantly unconstitutional.” If approved, the financial responsibility aspects of HB 1504 would take effect Jan. 1, 2027. In addition, “assault rifles” are identified by the bill as weapons that accept detachable magazines and possess one or more of the following features: pistol grip, barrel shroud, telescoping or folding stock, thumbhole stock, bayonet mount, flash suppressor or muzzle break, a threaded barrel, a grenade launcher, shotguns that can accept detachable magazines, fixed magazines that hold in excess of 7 (now 10) rounds. Similarly, Connecticut passed a law restricting “assault rifles” which they define as selective fire weapons, or weapons placed on a limited (and somewhat arbitrary) list of semiautomatic AR, AK, and SKS variants. Magazines with capacities over 10 rounds are restricted, although ones owned prior to April 4, 2013 are grandfathered in as long as they are registered. Both Connecticut and New York’s laws were sued upon and eventually decided in the U.S. Court of Appeals for the Second Circuit. The Second Circuit court decided that although AR-15 style rifles are “commonly owned” because the answer to whether such weapons are “dangerous and unusual” was “elusive,” the right could be infringed upon. In short, the court said that while owning AR-15 style weapons is protected by the Second Amendment, the government could infringe upon that right if they have a “legitimate interest,” such as saving lives. In finding, the court said that AR-15 style weapons are “disproportionally used in crime, and particularly in mass shootings like the attack in Newtown.” The court used language borrowed from the court in Heller v. D.C. and the 1939 decision in U.S. v. Miller which suggested that the guidelines on what weapons could be lawfully owned under the Second Amendment should be based upon what weapons are in common use. Under this guidance weapons fitting under the title of “assault rifles” for purposes of the ban are protected as some of the most popular weapons sold in America. In fact, by some estimations sales of AR and AK style weapons each year outpace the sale of F150 pickup trucks in America. Even by the estimations the Second Circuit court used AR style weapons account for 2.5 % of all weapons owned in America, or roughly the same percentage of Toyota Prius’ on the road as compared to the total number of cars on the road, which the court decided was sufficient to establish common use. However, the recognized 2nd amendment right was not afforded strict scrutiny, which would have required that the New York and Connecticut laws which impact a constitutional right must serve a compelling state interest, and be narrowly tailored and necessary to serve that interest. Almost every other constitutionally enumerated right is tested using the strict scrutiny test in the courts. Instead, the Second Circuit decided that although the answer was elusive to the question whether AR style weapons are “dangerous and unusual,” they could still be banned as a way to prevent gun violence. The court used intermediate scrutiny in this determination (the proposed law is “substantially related” instead of “necessary” to the State interest at issue). It is unlikely this law would have passed a strict scrutiny test, as it seems to broad, and lacks the evidence needed to show that the law would be necessary to meet the State interest in minimizing firearm related deaths. After the Second Circuit decision, the firearm owners group who sued, the Connecticut Citizens Defense League (CCDL) appealed the decision. Unfortunately, the Supreme Court denied certiorari and said that they would not hear the case, thereby letting the Second Circuit decision upholding the law stand. While we do not know how this would have played out in the Supreme Court after the passing of Justice Scalia, we know that New York and Connecticut residents will remain burdened by the ban for the foreseeable future. Unfortunately, even at the federal level “assault weapon” bans are not unheard of, and the federal government in fact banned such weapons between 1994, and 2004, when the ban expired. Congress chose not to renew the ban after its expiration. The overall constitutionality of individual states instituting such bans is still undecided, as the Supreme Court has not yet heard a case on the issue. District Courts remain somewhat split on the matter, or at least split on what test to use to properly evaluate assault weapon ban laws. The court of appeals for the Fourth Circuit said that a lower court used the wrong standard of review when they chose not to use the strict scrutiny standard in reviewing a Maryland assault rifle ban. That case has been sent back to the lower court to be reheard using the strict scrutiny standard. While Pennsylvanians remain solidly protected from such State weapons bans by our State constitution, it is wise for responsible gun owners to pay attention to the political landscape, and the potential for the federal government to attempt a renewal of such a ban in the future. States in other districts instituting similar bans can act as test cases for how a national ban may play out. Even for gun owners that do not own weapons that fit in the “assault weapons” category, remaining vigilant of our rights is important to prevent sliding further on what can be a slippery slope.
