Hospital conspires with police to kidnap child

Mr. and Mrs. Sieferts had a transgender child, who was showing signs of potential self harm. After a week in the hospital, the child was deemed to no longer need medical attention. The parents wanted to take their child home.

What happened next is hard to believe. The hospital REFUSED, despite no medical need, because the parents didn't have the right politics when it came to their transgender child. Conspiring with children services (that is, the government), the hospital refused to allow the child to leave unless the parents agree to raise the child as the hospital saw fit.

The Sieferts sue both the hospital and the government for a range of violations, including due process violations and 1983 violations. But 1983 only applies to government actors - that doesn't include the hospital ... or does it?

In today's legal analysis, we review the detestable actions of the hospital and government, and note how the State is coming after parents of transgender children who are not sufficiently progressive.
