Lake Erie gets a bill of rights?

The City of Toledo wanted to promote clean water. That's good! However, they passed a regulation that provided Lake Erie, as such, "the right to exist, florish, and naturally evolve." We are granting rights to the Lake, folks! Who will speak for the lake? No, seriously ... who? - it's an issue of standing.

Also, I am not a geography expert or anything, but I am reasonably sure that Lake Erie is not confined to the jurisdiction of the City of Toledo. Other jurisdictions may have something to add.

The City of Toledo also wanted to preempt federal law to the contrary! Um, no ... not so much.

In today's legal analysis, we discuss the rights of Lake Erie, and whether the City of Toledo can pass rules that govern a lake that multiple state and nation lines.
