Police shoot someone LYING on the GROUND

In today's episode of "cop does bad thing, can they be sued?", Mr. Smart was leaving a bar at closing time in Wichita. The police, who apparently heard shots (from somewhere) saw Mr. Smart and shot him (why? who knows?). And then, when Mr. Smart was on the ground with his arms outstretched, the police shot Mr. Smart AGAIN, killing him.

This is a thing that apparently happened.

In today's legal analysis, we discuss whether it is ok for the police to shoot you when you are already on the ground and defenseless, and if it is not ok, can the police be sued?
