The ORIGIN of Supreme Court review

It's an all time classic - Marbury was appointed to be a judge and the senate confirmed. However, Madison, the leader of the new administration, didn't want to deliver the commission. Marbury sued, arguing he was entitled by right. A decision either way would have political fallout - but is there a third option?
