LAWYER EXPLAINS EXTREME FORD EMERGENCY REGULATIONS: Parking Officer can make protest illegal.

Good afternoon, I am a retired litigation lawyer with over 30 years of experience in Ontario courts.

Oh my. Just when you thought things could not get worse in Ontario. Well, Our Lord Protector, Premier Doug Ford, under his fake emergency, has issued a new Ontario Regulation, 71/22, about you exercising your civil rights in Ontario: in a nutshell: you got none. It states: All people who "impede access" to any public space are now subject to police order to disperse immediately in Ontario, -or else. Under s. 3(1) of Regulation, no person shall impede, directly or indirectly,the use of any highway, as defined by the Highway Traffic Act, being also any, "street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle." Even trestles!

Let's review great moments in time when people impeded access to a public place. Tianemen Square, China, 1989. They were not there for anything too serious an issue like some power-crazed government forcing them and their children to be jabbed with a drug. They were not there to protest being all under house arrest, all being denied work, all being denied permission to leave their country. Nothing that dramatic. No, several hundred thousand students gathered to demonstrate for silly little things like constitutional due process, democracy, freedom of the press, and freedom of speech, you know, fundamental human rights. And God knows, the Chinese Communist Party. like Ford today, deemed them to be a fundamental threat of "mass death and destruction", as now declared by our Supreme Leader Respected Comrade Ford. And no, it wasn't a protest, hell, we love protests in this our wonderful freedom'n'democracy paradise. It was an occupation. These students actually with their bodies actually occupied space. Ford should be the last person objecting to anyone's body occupying too much space. So, because they weren't protesting, they were occupying space, or "taking up space" as Adolph Trudeau would put it, and refused to stop occupying space, police opened fire and about 3,400 were murdered.

But that was then, and this is now. So lets' look at more recent times people were impeding access to a public space. Oh yes, the "mostly peaceful" BLM protests. No, they weren't terrorizing residents with honking horns, just the soothing sound of burning police stations, exploding vehicles, gunfire and megaphone screams. That's something I can drift off to sleep to. And let's all tip our hats at the police then, who as are resident Karens demanding now, imposed the full force of the law to protect its dear citizens' right to sleep, by showing up in large numbers then, and, ...well, kneeling on a road, which was either a little known Tae Kwon Doe self-defence posture, or pure political cowardice. And speaking of cowards, here's Adolph Trudeau taking up public space, showing us how to live life on our knees.

But this Regulation gets worse. Nothing makes an authoritarian dictator acting in the name of the people, more angry than seeing the people show up to support protesters. Ford's spiritual inspiration, the late Romanian Communist dictator, Nicolae Ceaușescu, got so mad seeing his people join up with workers, he too arrested thousands for "mischief", with his police torturing and murdering many. His people eventually got wise, overthrew him and had him shot by firing squad. Hmmm, perish the thought.

S. 2(2) of the Regulation stipulates that "No person shall provide assistance to another, ...including by providing supplies, fuel or other materials." In most countries facing serious civil wars, this means weapons, ammo, explosives, bombs. Here in Ontario, providing a double double coffee to a freezing driver makes you a criminal. This is how crazy and maniacal with fear are our authoritarian elites. The true emergency is found in their underwear.

And of course, totalitarian government never gives up an opportunity to steal your property. And for that, the powers that be want more than total control of today and tomorrow. This Regulation wants to bring us back to the future. It subjects property to seizure of, to quote s. 4(1)(c) property used in "contravention before this Order takes effect." How you contravene an Order not in effect is something only our corrupt and political cowards on the Ontario Court bench could argue with a straight face.

But that's not the end of the story about this nasty piece of fascist boot stomping by Ford and his authoritarian acolytes. As we all know, this attack is directed at working class Canadians who have parked perhaps their one and only biggest asset, their trucks. Under what we call the rule of law, before the state steals your property, you are entitled (a), to being presumed innocent, (b), to fair notice, and (c), to arguing against it before an unbiased judge. Ha! Hah! Screw a, b, and c, and any other stinking letter you think entitles you to your rights.

Under 5(4), It allows for one of those parking tickets dolts, as Provincial Offence officers, to seize your truck, without so much as even writing you a ticket. And of course, as always, it goes even further.

Under s. 6, when the Ontario motor vehicle registrar thinks you have violated this Regulation under any of its terms, be you driver, protester, or simply someone who brought coffee, even before this Order came into effect, the Registrar can cancel your driver's license and your plate. Pretty draconian, you think?

It takes away your statutory right to appeal the Registrar's cancellation and further, provides for its effect even if you don't receive any notice. A driver's license, a truck, is needed to work. They want to impoverish and starve you into shutting the fuck up.
This is fascist Ford baring his teeth. If anything, this is unacceptable. This is a war on the people of Ontario.

Ford now shares a lot more than meets the eye with the fat Italian dictator, Mussolini with his buffoonish swagger and love for Hitler, who ended up hung upside down and naked by his people. Ford has declared himself an enemy of democracy, an enemy of the rule of law, and an enemy of human rights. Time to resist. Time to fight back. Start honking. Honk loud, honk long, and keep honking until we are free of these fascist, violent and extremist authoritarian thugs. Freedom is at stake, not only for us, but for all our children. Don't give up, hold the line! The world is watching Canada, time to score a goal.
