Kathy Hochul, Dept of Health and Law Enforcement admit they cannot enforce mask wearing

Businesses in Towns all over Erie County, Counties all over the state have decided they are not, and will not enforcing mask wearing. These businesses have signs up telling patrons that they will not, and do not discriminate for any reason, including masks. These businesses are also exercising their legally afforded rights to put signs up prohibiting any and all government officials from entering their establishments. And if any government official does enter into their facility, that official will be issued a criminal trespass warning, and have complaints issued against their oaths of office.

Kathy Hochul has admitted in open press conferences that she cannot force counties in this state to force mask wearing. This is evidenced by the actions and statements of county executives and county legislatures all over this state. 37 Counties have banded together to state very clearly they will not enforce any lockdown, mask mandate or injection mandate. They have gone on further to state that it would be a violation of the law and Constitution for them to do so.

Several County legislators and executives across the state, notably the Niagara County Executive, have stated that they have no idea how Mark Poloncarz has declared a perpetual state of emergency. He said he has no ability or authority to do that. And if he did, he would be held accountable and prosecuted.

Towns across this county have made statements and resolutions that they will not force any mask mandates in their towns. They will also not force any injection mandates or lockdown measures. They have signed resolutions that state this, and have told all county government employees to stay out of their towns, and the businesses in their towns. Notably Marilla, Garnd Island and Newstead.

Several other town supervisors and mayors in this county have stated they are not enforcing and mask mandates at all. Local Law Enforcement Chiefs have also stated they will not be enforcing any mandate or lockdown. In addition, Erie County Sheriffs Dept has been very reluctant to assist the Dept of Health in helping them enforce this measures.

Local businesses have not been fined by the Erie County Health Dept for not wearing masks. Not one fine has been issued to any business. The reason for this is they know they cannot. They can only issue warnings. This has been confirmed by area businesses who have contacted the Erie County Dept of Health and asked for them to provide to them, in writing, the fact that the Dept cannot issue fines to businesses. The Erie County Dept of Health has not only stated this to business owners, but has also, in writing confirmed this.

Local businesses are fed up with being used as a tool to enforce masks. Several of these businesses have written official letter and emails to government officials. These letters state that they will not put their employees at risk of an exchange with a patron. That they have no right to ask a patron to wear a mask because they do not know the patrons medical history. In Gail Burrstein's mask proclamation, in every paragraph she qualifies the statement by writing "Only if you can medically tolerate it". Businesses are writing and saying they have no authority to force masks on people, that forcing masks on people has cost them a lot of money and business, that forcing masks is not their responsiblity and that if the Dept of Health wants to force mask wearing, they should do that themselves.
