Nancy Pelosi Is Wrong About Trading Stocks in Congress

On Wednesday, as President Biden’s agenda faltered again in the Senate, Speaker of the House Nancy Pelosi came out swinging. Not against Joe Manchin, or the business interests he mollifies, but against a ban on members of Congress being able to trade stocks. “This is a free market, and people — we are a free market economy. They should be able to participate in that,” she told an Insider reporter after a recent investigation by the publication found that “49 members of Congress and 182 senior congressional staffers have violated the STOCK Act, a law to prevent insider trading.”

Congress and the Insider Trading Prohibition Act: “Can’t Anybody Here Play This Game?”

Last week, the House of Representatives passed the “Insider Trading Prohibition Act” (“ITPA”).[1] Proponents are hailing it as a triumph of bipartisan cooperation. Conversely, critics are calling it the “Insider Trading Protection Act.” This is because the bill codifies in statutory law the “personal benefit” requirement under which the tippee can only be convicted if that person paid or promised some benefit (tangible or even intangible and reputational) to the tipper. That requirement had resulted in many convictions being overturned (and even more prosecutions probably not being commenced in the first place). In the Second Circuit, this doctrine had led prosecutors to turn to other statutes: chiefly, wire fraud and a special securities fraud statute (18 U.S.C. Section 1348) to outflank it. Seemingly, this approach has worked, as in Blaszczak v. United States[2] a Second Circuit panel agreed that “personal benefit” was not a necessary element for either a wire fraud or Section 1348 conviction.[3]

Gov. Kate Brown is taking heat on social media after being spotted maskless at an event in Washington, D.C., while maintaining her controversial indoor mask mandate at home.

Brown was in the nation’s capital Saturday for the 30th anniversary gala of the Victory Fund, a national organization dedicated to electing LGBTQ candidates to public office. Brown, a bisexual and the first openly LGBTQ governor, was inducted into the organization’s hall of fame at the event.

Trudeau reduces sentence for serious gun crimes

On Tuesday, Prime Minister Justin Trudeau promised to crack down on gun crime, then on Thursday his government introduced legislation to reduce sentences for serious gun crimes including weapons trafficking and importing.
