The law, whilst the Universal Declaration of Human Rights was constructed and agreed via the transatlantic treaty in 1947, the British were not a signatory to it. Therefore, the law (British Judiciary) sees it as persuasive rather than law.
However, two international covenants are the law as ratified and signed by the British;
1. International Covenant on Civil and Political Rights (ICCPR)
2. International Covenant on Economic, Social and Cultural Rights (ICESCR)
The first was Adopted and opened for signature, ratification and accession by General Assembly resolution 2200A (XXI) of 16 December 1966 the British entered this into force 23rd March 1976, in accordance with Article 49, the second entered into force 3 January 1976, in accordance with article 27.
Preamble:
“Realizing that the individual, having duties to other individuals and to the community to which he belongs, is under a responsibility to strive for the promotion and observance of the rights recognized in the present Covenant”,
Agree upon the following articles: (ICCPR)
Article 17
1. No one shall be subjected to arbitrary or unlawful interference with his privacy, family, home or correspondence, nor to unlawful attacks on his honour and reputation.
2. Everyone has the right to the protection of the law against such interference or attacks.
Article 1
1. All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.
3. The States Parties to the present Covenant, including those having responsibility for the administration of Non-Self-Governing and Trust Territories, shall promote the realization of the right of self-determination, and shall respect that right, in conformity with the provisions of the Charter of the United Nations.
