A Group Of 11 States Are Joining Together In A Legal Effort To Challenge The Authority Of The Biden Administration And Their Move To Reverse A Key Trump Era Immigration Policy.

The States, Led By Arizona, Filed A Motion After The Administration Announced That They Were Not Going To Defend The 'Public Charge Rule' And Dropped Its Legal Challenges- Meaning That It Would Not Be Heard By The Supreme Court.

The "Public Charge" Rule Was Introduced By The Trump Administration And Was Put In Place To Make Sure That Migrants Coming Into The United States Could Support Themselves. The Migrants Would Be Considered A Public Charge If They Received Public Benefits For More Than 12 Months In A 3 Year Period.

That Designation Would Then Impact Their Chances Of Getting A Green Card.

According To The Department Of Homeland Security, Defending The Rule "Is Neither In The Public Interest Nor An Efficient Use Of Limited Government Resources."

The States Are Now Stepping In So That They Would Have The Opportunity To Petition The Supreme Court To Accept Review Of The Case And Have The Case Heard.

The Attorney General For Arizona Released A Statement Saying,

"It Is Unconscionable To Overwhelm Our Infrastructure And Immigration Personnel When We Are Dealing With The Health And Economic Devastation Of The Pandemic," He Said, "While Regardless Of One's Position On Immigration Reform, This Reckless Violation Of Federal Law Is Only Creating Another National Crisis And Putting Additional Strains On Our State And Hardworking Arizona Taxpayers."

In The Brief The States Claim The Move Will Cost Taxpayers And States About $1 Billion Dollars

According To The Migration Policy Institute 10.3 Million Out Of 22 Million Foreign Nationals In The U.S. Are On Welfare.
