On February 27, 1933, less than a month after Adolf Hitler had been sworn in as Chancellor of Germany, an impulsive young Dutchman named Marinus van der Lubbe set fire to the German Parliament building. The twenty-four-year-old unemployed mason had recently left the Communist Party for a radical anarcho-syndicalist organization. He attempted to burn down a welfare office, then the town hall and a former palace in Neukölln. Then, in his anger and desperation, van der Lubbe decided that, as one of the greatest symbols of bourgeois power in Germany, the Reichstag had to go. But for years Communists and Nazi paramilitary groups had been fighting in the streets of German cities, and Adolf Hitler and Herman Göring knew that, in Hitler’s words, “The German people won’t have any understanding for leniency.” In other words, this was their opportunity to destroy the German Communist party, root and branch. Evans writes, “It allowed the police to detain people in protective custody indefinitely and without a court order, in contrast to previous laws and decrees, which had set strict time limits before judicial intervention occurred.” The primary targets were indeed the Communists, and 10,000 of them were detained within two weeks; the party was effectively outlawed in Germany from this time forward. But civil liberties for everyone, not just Communists, were drastically curtailed. The eventual results of these decrees are, it’s safe to say, common knowledge.
