A constitution is the framework within which those elected and appointed to governmental positions operate. When an elected or appointed official is operating outside the established framework of the very constitution they are supposed to operate under then they have become a lawbreaker because their actions are unlawful.

If a society accepts unlawful conduct as being permissible, even under the pretext of an emergency, then that society has accepted lawlessness as their foundation and will ultimately suffer the consequences of lawlessness.
