Good evening, I’m still reporting on the coup.
The legal battle for President Donald Trump to stay in the White House is no longer about him reaching 270 electoral college votes, but denying Joe Biden from getting 270 by presenting sufficient evidence of ballot counting misconduct to cause several states to be flipped over to the Republican side – or, at least unable to certify the vote tallies as they currently exist – thereby removing votes from Biden.
If Biden or Trump fails to win a majority of votes in the electoral college, the Constitution and the 12th Amendment directs the new Congress convening in January 2021 into what’s known as a “contingency vote” situation to select the new president.
Though Democrats may control the House in 2021 – albeit narrowly - the 12th amendment provides that each state delegation will meet and vote as a bloc, because each state – and the District of Columbia - will get only one vote. This gives much more power to the smaller states than if one candidate hits the magic 270 electoral vote marker.
Today, Republicans hold a small advantage in the contingency vote IF all representatives vote party line.
When still back at the Electoral College level, in 2016 there was a lot of talk about “faithless electors” – electors who did not end up voting for the candidate that they were pledged to when they were selected by their state legislatures. But in July of this year, 2020, the U.S. Supreme Court ruled unanimously that electors have to vote as they promised to do or their state can remove them.
But if this gets to a “contingency vote” by the U.S. House of Representatives to decide who should be the next President, no such rules apply. The House – so far – has flipped a dozen Democrat seats over to the Republicans with many more races still undecided. It is highly likely that many of these will not support the progressive agenda Joe Biden is espousing – at least, if they want to be re-elected when they stand for re-election in 2022.
So, all Trump has to do is to prevent Biden from gaining a solid 270 vote majority in the Electoral College, and then Biden has no path to victory – in my humble opinion.
Biden’s existing wins are under a huge attack by Trump’s legal team, and rightly so. There is significant evidence that during the shutdown of the voting in the big battleground states in the wee hours after the polls had closed, major mysterious injections of 100% Biden votes were inserted into the counting system, and it is likely that these cannot be backed up by any shred of paper ballots.
It’s fairly certain the Supreme Court would rule that these mysterious additions will be thrown out, thereby flipping one or more blue states over into the red column, and sending President Trump back to the White House for a second term.
