Freedom Fight: DA Gives Crucial Update on Menendez Brothers’ Case Amid New Trial Push

On March 10, 2025, Los Angeles County District Attorney Nathan Hochman provided an update on the case of the Menendez brothers, Lyle and Erik, as they continue their fight for a new trial and potential release from prison.

The Menendez brothers were sentenced to life in prison without parole in 1996 for the 1989 murders of their parents, Jose and Kitty Menendez. They claimed their actions were in self-defense after years of sexual and physical abuse by their father. Recently, they have filed for a retrial based on new evidence, including a letter allegedly written by Erik to his cousin in 1989 and allegations from Roy RossellĂł, a former member of the boy band Menudo, who claimed that he, too, was sexually abused by Jose Menendez as a teenager.

However, in late February 2025, DA Hochman opposed granting a new trial, arguing that the new evidence was not strong enough to overturn the original conviction. This decision has frustrated the Menendez family and advocates for a retrial, who believe that modern understandings of trauma should be taken into account.

Notably, the Menendez brothers' uncle, Milton Andersen, who opposed their release, passed away on March 3, 2025, at the age of 90. He was the only family member to publicly reject their plea for reduced sentencing.

Currently, California Governor Gavin Newsom has directed a state clemency board to conduct a “risk assessment” for Erik and Lyle Menendez, a potential step toward clemency. This review will determine whether they would pose any threat to the public if released.

A hearing is scheduled for March 20-21, 2025, where the Menendez brothers' attorneys will continue to argue for reduced sentencing or a new trial based on newly surfaced evidence and their rehabilitation efforts in prison.
