Oshkosh, WI - No criminal charges will be filed against an Oshkosh police officer who shot and killed an armed suspect at the scene of a stabbing.

Winnebago County Assistant District Attorney Tracy Paider says the officer's use of deadly force was reasonable and justified in the death of Delveon W. Fairman.

On Dec. 10, 2024, around 11:10 p.m., officers responded to a home in the area of the 400 block of W. 10th Ave. for a report of a stabbing.

Upon arrival, officers found a victim outside the home who had been stabbed.

Authorities say officers entered the residence, where they encountered Fairman armed with a bladed weapon.

Fairman failed to comply with orders from the officer to drop the weapon, and one officer fired, striking Fairman. The officer is not named in the reports.

While officers performed life-saving measures on Fairman, a second stabbing victim was located in the residence.

Both stabbing victims and Fairman were taken to the hospital.

Fairman was pronounced dead at the hospital.
