Justice Gableman explains why the Wisconsin Election Commission has violated the voting law in the past and how indefinitely confined were use to vote. February 2025:
The new rules being offer by the Wi Election Commission again violates the law.
Absentee Voting in Residential Care Facilities and Retirement Homes: WEC egregiously ignores § 6.875(6)(b) that clearly states an observer can observe the election process in the room of a nursing home resident.  It reads: “for purposes of the application of Wis Stat 7.41, the home or facility SHALL be treated as a polling place”. The word “SHALL” indicates something is mandatory. Observers are protected by the law to observe all aspects of the voting process wherever that may be taking place. Furthermore, closing of doors is a safety issue.  Nobody has the authority to make a regulation that interferes with a statute.  There isn’t one observer who cares about how someone votes.  We care that the voting process was administered properly.
