The killing of a man involved in a gunfight with Yuba County deputies last year was justified, the Yuba County District Attorney’s Office said Thursday.

In a news release, the district attorney’s office said all officers have been cleared in the killing of 22-year-old Donn Moore.

Investigators say it started when a deputy noticed a suspicious truck in Loma Rica on Sept. 24, 2024. The driver, Donn Moore, drove off after seeing the patrol vehicle and led law enforcement on a 23-minute chase at speeds of more than 90 mph.

The chase ended on Highway 20 east of Marysville when his vehicle became disabled by spike sticks, according to law enforcement.

Officers reportedly told Moore to surrender, but he stuck his arm and head out of the driver’s side window and pointed a gun at the officers. They ordered him to drop the gun, and he fired it.

Three Yuba County deputies and two Yuba City officers returned fired. The five officers fired a total of 24–40 rounds in eight seconds and one of the rounds hit Moore, killing him.

The district attorney’s office says investigators found Moore was high on meth, and in the months leading up to his death, had become violent by attacking his ex-girlfriend, threatening to kill her and asking her to kill him.

The district attorney’s office also says Moore believed there was a warrant out for his arrest and that he’d go to prison. His allegedly told his ex-girlfriend he would “shoot it out with the cops” to avoid returning to prison.
