MINUTE ORDER as to CINDY YOUNG re 118 MOTION to Vacate Surrender Date filed by CINDY YOUNG. Defendant has filed a motion to vacate her surrender date, scheduled for January 27, 2025, in light of the Executive Order dated January 20, 2025, which granted pardons to individuals convicted of offenses related to events that occurred at or near the United States Capitol on January 6, 2021. See ECF No. 118. It is hereby ORDERED that the government shall respond to the motion by 5:00 p.m. on January 23, 2025. The response shall address whether the Court has the authority to vacate a surrender date imposed by the Bureau of Prisons and, if not, the proper procedure to ensure that Defendant is not required to surrender to serve a sentence for a crime for which she has been convicted and pardoned.
