Stephens County Georgia "Under Color of Law" Part I

On May 11th, 2024, Lawrence (Larry) Leitgeb arrives at his father's former house to get his deceased father's belongings including his father's wood working tools. Prior to this event, the two families were working together to separate items. The grandchildren were rude from the day they arrived for they had called the police to trespass his wife the day before. From Lawrence's perspective, the GRANDCHILDREN WERE TRESPASSING. Lawrence was told by the Scott family that they would only be there to drop off their stuff, but would not officially move in until the end of the month. This would give Lawrence the full week or two he needed to sort through his father's belongings of sentimental and monetary value and put his father to rest. In hindsight, this was likely all a set up.

In response to the grandchildren's 911 call, Lawrence's lawyer gave Lawrence an official document on May 10th making him the executor of his father's will. As you will see, this was ignored by Harris.

It was not unreasonable to ask if these rude children had a lease or any official document. When Lawrence spoke of an eviction notice, he is repeating his lawyer's words. She indicated that the estate should have been given formal notice to vacate premises.

Deputy Harris says several times that he has no authority over civil matters and that he is only there to keep the peace. If this was true, then why would he give Lawrence's truck keys to this couple who is presumed to be complete strangers to him (parts II and III). Is he a lawyer that he knows how to read a will?

Note the conversation he has with the alleged owner of the property. This Deputy is no peace officer. Harris drives a wedge between the families by claiming Lawrence said things that he did not say. Lawrence had no intentions of taking possession of the house or living there. The trailer should have indicated to the deputy that Lawrence was there to separate out his father's possessions. When Charles Scott tells Harris that Lawrence is allowed to take the furniture, the Deputy mocks Charles for his kindness. Moreover the deputy never allows Lawrence the time to remove these larger items.

Harris explains that the only thing that matters here is who paid the property taxes. (The fact that Lawrence's father paid 50% is irrelevant for this argument.) The question is why did not Harris apply that same principle to Lawrence's truck?

Georgia code section-53-6-2 states, “Any person who, without authority of law, wrongfully intermeddles with or converts the personalty of a decedent whose estate is unrepresented shall be deemed an executor de son tort and as such shall be liable to the creditors and heirs or beneficiaries of the estate for double the value of the property so possessed and converted.” We shall see one day who is at fault here.
