“Graphics and peoples and images that indicated the … sexual assault of what appeared to be children….”

In January of 2016, a 4-year old girl accused her father, a policeman, and her step-grandfather of sexual assault in the basement of her step-grandpa’s house – where the father would take his little girl every other weekend for his custody visits. The little girl’s step-grandfather, Larry Orr, was already a convicted sex offender on the Michigan Registry for having admitted to multiple rapes of his wheel-chair bound, brain-injured physical therapy patient when that patient was 13-15 years old. Based on the strength of the child’s allegations and forensic interviews, warrants issued for the sex-offender’s house. In the basement, among other corroborating items, six seminal fluid stains were found, about which the Michigan State Police Forensic Lab report concluded that it was “at least 160 septillion times more likely if it originated from [Father] than if it originated from an unknown, unrelated contributor” and – in reference to step-grandfathers’s seminal fluid stains, the Michigan State Police Lab stated: “CONCLUSION: Based on the DNA typing results obtained from the carpet swabs… it is at least 320 quadrillion times more likely if it originated from Larry Orr than if it originated from an unrelated, unknown donor.”

Based on the above quite compelling DNA evidence – note that a “septillion” has 24 zeroes after the number and is numerically denoted as 160,000,000,000,000,000,000,000,000 – Michigan officers arrested the grandfather, while Florida law enforcement arrested the girl’s father and also seized the father’s electronic devices. The dad’s electronics were then reviewed by two different law enforcement officers – who then testified subsequently under oath – that the father’s devices contained apparent images of:

“We found pictures, naked pictures of both boys and girls that appeared to be possibly prepubescent….”

“Graphics and peoples and images that indicated the … sexual assault of what appeared to be children….”

“Very young children involved in sexual acts with adults.”

“Very young children appearing to be tortured and/or in bondage.”

DeSantis extradited father to Michigan where both men faced a bond hearing, and Judge Nancy Carniak on May 16, 2019, held them over without bond, stating:

“Quite frankly, in almost 20 years I’ve been on the bench, I’ve never denied an individual bond. But I think if there’s any case, this would be the case, for the following reasons….”

This above evidence from dad’s devices was further corroborated by the child herself, when she testified under oath to Judge James P. Nilon of Alachua Family Justice Center in the context of a later child custody matter that her father would sometimes:

“Make me take off my clothes, and he would videotape me with his cell phone, dancing….”

Unfortunately, Judge Nilon then sealed the transcript – and also ordered his therapists on the case to NOT discuss the abuse with the child, and further ordered the therapists to NOT report to child welfare agencies though they were mandated reporters:

“‘The psychologist shall not continue to explore past child sexual abuse.’ So that’s what I would say is – regarding your question about the disclosure that [child] made to you. And that’s why I would say it was appropriate NOT to inform the Michigan authorities as a mandatory report….”

Further, on his last day before retiring from the bench at the end of December 2020, Judge Nilon held the mother in contempt for cooperating with the Michigan Attorney General Investigation and police investigation, and as well for having gotten the child therapy, issuing a 91 paragraph order entering “judgment against the Former Wife for $237,689.21 plus post-judgment.” This order holding a non-offending mother in contempt and fining her nearly a quarter million dollars immediately bankrupted the child’s mother.

Judge Nilon then transferred the case to his colleague, Judge Robert Groeb of the Alachua Family Justice Center, who continued Judge Nilon’s orders that disallowed the evidence of “alleged sexual molestation” from coming into the child custody hearing, deeming that the above evidence was NOT credible, and which judge further prevented the child from testifying in her own behalf – even though she is now almost 14 years old.

Horrified by this ruling which muzzled an almost 14 year old victim alleging rape at the hands of her father, which ruling entirely flouted Florida State Appellate court precedent (Harrell v. Friend) that holds that a child’s preference IS relevant and that trial courts “should allow them an opportunity to be heard” – and also equally appalled at the earlier rulings on this case by which the judge held the mother in contempt for having cooperated in an active State Attorney General and law enforcement criminal investigation that yielded exceedingly compelling DNA evidence as well as images on the alleged perpetrator’s phone of what appeared to be “very young children involved in sexual acts with adults” and “appearing to be tortured and/or in bondage” – Leigh Dundas elected to hold a press conference on the Alachua Courthouse steps on the first day of the custody trial in order to give voice to the silenced rape victim. Unfortunately, on Tuesday, January 7, 2025 Judge Groeb in Case # 01-2012-DR-004780 of the Alachua Family Justice Center located at 201 E. University Avenue in Gainesville Florida did NOT allow the mother and child to put on any evidence or call any of their witnesses during the “mother’s” one day of this 2-day trial. Instead, Judge Groeb – quite cleverly – summarily ruled first thing Tuesday morning against the father’s motion to get FULL 100% custody of the child … which caused the earlier agreement/order on the case to go back into effect … by which the father is now entitled to 50/50 custody IMMEDIATELY – and with NO supervised visitation.
