Cop Thinks He Get Away With Traumatizing A Family Wrongful Arrest - But He Didn't

At approximately 17:18​, on 8/21/2024, Officer Stiltner of the Florida Fish and Wildlife Conservation Commission (FWC), along with Officer Gilmore, also of FWC, were on water-based patrol in the Loxahatchee River in Palm Beach County, FL. A vessel bearing Florida Registration Number ***** was observed operating westbound outside the channel in the Loxahatchee River, approaching a shoal in a Slow Speed Minimum Wake Zone.
Officer Gilmore conducted a vessel stop to address the violation. The owner and operator of the vessel was identified by name and date of birth during the stop. The operator continued moving forward while Officer Gilmore attempted to stop the vessel, which was slowed by the shoal. Multiple instructions were given to the operator to trim the motors to clear the shoal.
The operator was informed that the reason for the stop was a slow speed violation. There were four young children, two women who claimed to be pregnant, and another man on board the vessel with the operator.
Phase 2 - Personal Contact with the Operator of the Vessel:
Upon contact, the operator was instructed to put the vessel in neutral. When instructions for a boating safety inspection began, it was noticed that the operator had placed the vessel in reverse. The operator was again instructed to put the vessel in neutral.
The operator stated ownership of the vessel and provided the registration, which was linked to a business. The operator was asked to provide lifejackets for everyone on board, excluding the children who were already wearing theirs. Approximately 10-12 lifejackets were retrieved from a compartment.
The operator was also asked to produce a Type IV throwable device, which was eventually located after searching several hatches. When asked for a fire extinguisher, the operator initially could not find one but later remembered it was in a black bag containing the vessel paperwork. When shown, the extinguisher’s gauge was held in a way that prevented visibility.
The operator was asked to provide a "bell, horn, or whistle." Initially confused by the request, the operator did not understand the terminology until further clarification. After searching for an airhorn unsuccessfully, the horn button on the dashboard was pressed to demonstrate compliance.
To ensure the operator was capable of safely operating the vessel, they were asked to wear a lifejacket and come aboard the officers’ vessel for evaluation. The operator initially wore the lifejacket upside down and failed to fasten it before climbing aboard. They had to be instructed to put it on correctly and were unable to secure the buckle without assistance.
Based on the vessel’s motion, personal contact, Standardized Field Sobriety Tasks, and the totality of the circumstances, the operator was placed under arrest for Boating Under the Influence while normal faculties were impaired. Handcuffs were double-locked and checked for tightness.
The operator was asked if they wanted to bring any personal items to jail. They opted to take their shoes but declined their phone or other possessions. Instructions were given to the operator’s spouse to call for assistance. The spouse reportedly contacted multiple high-ranking officials in the state, demanding the officers' names and badge numbers.
Officer Gilmore hip-towed the operator’s vessel toward their home until the channel became too narrow for both vessels. The operator indicated that a friend would retrieve them, and the remaining passengers anchored near their canal to await assistance.
At the PBSO BAT Center, implied consent was read, and the operator agreed to provide a breath sample, both of which returned a result of .000 g/210 liters of breath. The operator also agreed to provide a urine sample. After being read their Miranda rights, the operator declined to answer questions without legal counsel but consented to evaluation by a Drug Recognition Expert (DRE) at the PBSO BAT Center.
