Phoenix officers fatally shot a rifle wielding man inside a fast food restaurant during a shootout

The Phoenix Police Department released surveillance video on Thursday that shows the gun battle between an armed man inside a Whataburger and police officers outside during a standoff two weeks ago.

The video shows the suspect, later identified as 62-year-old Marion Douglas Joyner, walking into the fast food restaurant on Thunderbird Road near 28th Avenue around 11:15 a.m. on Dec. 18 from the back and into the front, ordering everyone to leave the store.

Multiple people called 911 about what had happened.

“He came ripping into the parking lot, slammed on his brakes and just walked in with it pointed straight up in the air,” said one 911 caller, referencing his gun.

“A guy came through the store in the back with a, it looked like a 9mm and an assault rifle,” one man told 911.

Several employees and at least one customer were inside the restaurant, and Joyner ordered everyone out. Surveillance video shows them running out of the store.

Police arrived and a standoff ensued for more than 20 minutes. During that time, investigators said Joyner walked out of the restaurant and pointed his gun at the police helicopter overhead.

The surveillance video appears to show the gun not working as Joyner had hoped. He then went back inside.

Joyner then fired his gun at officers through the glass windows of the Whataburger.

The surveillance video shows him shooting at police and then ducking behind a couple of booths.

Around 11:40 a.m., surveillance video shows police sent in a drone inside the restaurant.

When Joyner saw the drone, he raised his rifle and that’s when officers shot him.

Investigators said five officers shot at Joyner and police released body-camera videos from three of them.

One officer fired his gun while ducking behind a person’s car while the other was taking cover behind a Phoenix police SUV and returned gunfire.

The third officer was also behind a police SUV and fired his rifle four times.

“I think I got him,” he said in his body-cam video.

A police car was hit by gunfire but no officers were hurt. Joyner died at the scene.
