SCOTUS to Hear 17 State Lawsuit Challenging California’s Authority to Dictate US Emissions Standards

Seventeen states have sued the EPA challenging it giving California the authority to basically dictate US vehicle emissions standards for the country. It doing so, it has violated the Constitution’s guaranteed equality of states. Which of course the District of Criminals Court of Appeals in DC ruled that it does not bar the Federal Government from giving states it chooses a different level of “sovereign authority”. So, thankfully the US Supreme Court is taking up the legal challenge. And conveniently on the same day as SCOTUS taking it up, Biden’s EPA has granted California the “right” to ban the sale of new gas vehicles by 2035.
