Suspect fatally shot after firing a shotgun at a task force when serving a domestic violence warrant

A man died after being shot while law enforcement officers were serving a warrant in north Harris County Wednesday morning, according to Sheriff Ed Gonzalez. The suspect fired first at the officers with a shotgun, the sheriff said.

This happened on Luthe Road, just east of the Hardy Toll Road in the Aldine area.

The sheriff said more than a dozen members of the Gulf Coast Violent Offenders Task Force were serving a domestic violence felony warrant for aggravated assault on a 26-year-old man. They say he's accused of stabbing his girlfriend last week in Harris County.

The sheriff said the task force announced their presence, and a man and his pregnant wife ran out of the home with their 10-month-old baby daughter.

“Just told my wife to get on the ground, her and the baby," the suspect's roommate told us.

The suspect remained inside.

Members of the task force then approached the front door again and announced their presence in English and Spanish, giving the suspect inside an opportunity to surrender, the sheriff said. However, he refused.

Then the task force heard a gunshot coming from the room they thought the suspect was in, the sheriff said. They then tried to use a non-lethal weapon on the suspect, which did not work.

The suspect shouted back at law enforcement, claiming he was “not going out this way.” The sheriff said he then came out of the room with a shotgun and fired at the task force members.

One HPD officer with the task force fired back and hit the suspect, who was pronounced dead at the scene, the sheriff said.

“This suspect that's now deceased had every opportunity to turn himself in. He had other ideas in mind,” the sheriff said.

"There’s lights, there’s sirens -- every single step that we could possibly do to not have an outcome as tragic as this, where there’s a death involved, was used," Police Chief Noe Diaz said.

Friends and family identify the suspect as 26-year-old Ivan Guttierez.

“I just feel bad for his family, man, you know what I’m saying? He has three kids," the roommate, who didn't want to be identified, told us.

“And, you know, our condolences go out, obviously, to any family members that he may have," Gonzalez said. "And this is also traumatic for not only the officer that discharges the weapon, but the other members of the team and neighbors that were here present at this point.”

Guttierez's criminal history includes multiple charges of family violence, and he was out on bond when he allegedly stabbed his girlfriend.
