Bucks County Commissioners Defy PA Supreme Court: Counting Illegal Ballots to Sway Senate Race

Bucks County Democratic commissioners Diane Ellis-Marseglia (CommEllisMarseglia@buckscounty.org, 215-348-6425) and Robert J. Harvie Jr. (CommHarvie@buckscounty.org, 215-348-6424) voted to count misdated and undated mail-in ballots in defiance of the Pennsylvania Supreme Court ruling, aiming to assist Bob Casey in the Pennsylvania Senate race. Marseglia admitted knowing it's illegal but stated she did not care.

Democrats Marseglia and Harvie became the first Democratic majority on the Bucks County Board of Commissioners in 2019. The third commissioner, Gene DiGirolamo, a Republican, rejected Diane Ellis-Marseglia's challenges against the Pennsylvania Supreme Court, which has already provided clear guidance requiring signatures for votes to count. In the lead-up to Election Day, the state’s top court issued multiple orders declaring the handwritten date requirement must be enforced. At stake are at least hundreds of ballots, which could play a sizable role as the close contest between incumbent Sen. Bob Casey (D-Pa.) and challenger David McCormick heads to an automatic recount.

Bucks County is the same county caught on video ordering polling locations to close early and using the police to restrict voters' rights. Democratic Party attorney and "Democracy Docket" founder Marc Elias has allegedly aided efforts to sway the election. This explains why Democratic incumbent Bob Casey has not yet conceded.
