Trump's Lawyer Makes Letitia James A Deal She Can't Refuse

Posted • November 7, 2024: One of the humiliations confronting the Biden Justice Department in its last days and New York Attorney General Letitia James is how to handle the manufactured criminal cases they are pushing against President Trump. The federal issue seems to have been solved Tuesday. Not only were the charges obviously bogus and brought by an arguably unconstitutionally appointed prosecutor, but the Department of Justice's policy is that it will not prosecute a sitting president. A tougher case is the New York State civil case brought by Letitia James and the fraud prosecution by Manhattan District Attorney Alvin Bragg in which Trump has been convicted and awaits sentencing; see BREAKING: Judge Delays Donald Trump's Manhattan Case Sentencing Until After Election.

This case is more difficult because the DOJ can't order a state to stop its prosecution of a president, though that would be uncharted waters; see What’s Next in Trump’s N.Y. Even though that latter prosecution is at the local level, under New York law, the Attorney General has the authority to take over the case.
