The work “The State of Constitutionalism, Democracy, and the Future of the Nation” by Jose Stelle, makes a much needed contribution to the constitutional debate in China and stands out for rejecting the pure and simple imitation of Western democratic models. These are lectures that criticize Western-type democracy without incurring the same methodological and content errors as totalitarian anti-democratic critics, such as Carl Schmitt. Building on the democratic constitutional reform model proposed by F. A. Hayek in his book Law, Legislation, and Freedom, published in 1979, Stelle not only does Hayek justice with the description of his proposal, but also goes further, suggesting changes to that model that would significantly increase the governance of political society.
