Wow, I don't know how people can do this to children. It is depressing that this is not just happening in this region of the world but it is virtually part of every culture.

I recently saw the documentary on the Dancing Boys of Afghanistan. It exposed an ancient custom called "bacha bazi" (boy for play), where rich men buy boys as young as 11 from impoverished families for sexual slavery. The boys are dressed in women's clothes and made to dance and sing at parties, before being carted away by the men for sex. Owning boys is considered a symbol of status and one former warlord boasted of having up to 3,000 boys over a 20-year period, even though he was married, with two sons. The involvement of the police and inaction of the government means this form of child prostitution is widespread.

The moral hypocrisy is outrageous in a country where homosexuality is not only strictly forbidden but savagely punished, even between two consenting adults. However, men who sodomize young boys are not considered homosexuals or pedophiles. The love of young boys is not a phenomenon restricted to Afghanistan; homosexual pederasty is common in neighboring Pakistan, too. In my view, repression of sexuality and extreme gender apartheid is to blame.

Child marriage is against Islam as the Qur'an is clear that intellectual maturity is the basis for deciding age of marriage, and not puberty, as suggested by these clerics.

Whatever one's view on the prophet's marriage, no faith can claim moral superiority since child marriages have been practiced in various cultures and societies across the world at one time or another. In modern times, though, marrying children is no longer acceptable and no excuse should be used to justify this.

I find the false adherence to Islamic principles and the "holier than thou" attitude of some Muslim societies similar to the blatant hypocrisy and double standards of 19th-century Victorian Britain, where the outward appearance of dignity and prudishness camouflaged an extreme prevalence of sexual and moral depravity behind closed doors. In those days, too, there were many men willing to pay to have sex with children – until a plethora of social movements arose that resulted in changes in laws and attitudes in society.

A similar shift in social attitudes is also required in traditional Muslim societies. Having boy sex slaves or child brides should not be seen as badges of honor. I have heard many stories at first hand of child sexual abuse and rape, which show that the issue is not being addressed at all. Those who have had the courage to speak out have been met with reactions of denial and shame. Such attitudes mean that children will continue to suffer in silence. Sexual abuse of children happens in all communities, as has been revealed by the recent Catholic church scandal. At least, they have finally started to take action. Muslim communities should learn from this and also start being more open, instead of continuing to sweeping the issue under the carpet.

Let's bury once and for all the false dichotomy between power and sex, as in: "rape is about power and not sex". That's true in the same way that "bank robberies are not about money" is [not] true. For the male of the species, sexual expression and aggression (though not necessarily violence or degradation) go hand in hand. It's just part of our primate nature. Power is about expression of self in all its aspects. It would be interesting to learn more about this practice's resurgence. Specifically, whether there have been cycles of repression and resurgence in the past. It seems to be as old as the Persian culture itself, that is, thousands of years old. It is culturally accepted, especially by men in the Southern portion of the country, but is of course, no single area of the region is exempt from participation. Bacha Bazi targets young, Muslim boys, around the ages of 9-15. These boys are sent to parties or offices of esteemed men, dressed often like young girls, with bells on their ankles. They dance for these grown adults, are taken home by them, and often become owned by them. Yes, it is in fact culturally acceptable in Muslim country for men to own young boys and sexually exploit them.

This often confuses and angers American Soldiers world wide or even sex tourists and other tourists who walk down streets and see grown men locking hands with children who are obviously not their sons. They cannot stick up for these boys, or speak out against the act because this form of pedophilia is absolutely acceptable for a man in power, and there is no protection for these boys today. Anti-Muslim hate in US rises since 7 October 2023 but advocates praise community resilience. US Islamophobia ‘stands out for its enormity’ but movement for Palestinian rights is unprecedented in size and visibility.

Arafat Issa hangs Palestinian flags across a pedestrian bridge in Durham, North Carolina, almost every week. But on 28 July, a man in a baseball cap pulled out a knife and cut the flags down from the steel railing. Issa says the man cursed at him and his family before waving the knife in their direction. They had seven children, including Issa’s four-month-old daughter, with them.

“He told us: go back where you came from,” Issa says. “I was scared … it’s not like we were doing anything wrong. We were peacefully protesting.”

Issa is a 42-year-old Palestinian American barber who has lived in North Carolina for more than a decade. His parents and siblings are in the West Bank, where settler violence against Palestinians is escalating. His experience is one of many examples of anti-Palestinian and anti-Muslim hate documented by the Council on American-Islamic Relations (Cair) since 7 October of last year. “We are seeing an uptick in violent vigilante response to peaceful pro-Palestinian protesters,” said Nicole Fauster-Bradford, the community advocacy director at Cair.

Advocates say the aftermath of 7 October in the US had echoes of the fear that followed 9/11, when the government expanded surveillance powers that were largely wielded against Muslim and Arab communities, and hate crimes against them surged.

“Islamophobia comes in cycles – often tied to something in the news,” says Corey Saylor, research and advocacy director at Cair. The last year, he continued, “stands out for its enormity” of anti-Muslim hate.

On the other hand, the last year has also seen a movement for Palestinian rights that is unprecedented in its size and visibility. “This is not the community that was subjected to payback after 9/11. It’s much stronger now,” says Saylor. “Early on, there was fear. I would say that’s completely morphed to resilience”

From January to June of this year, Cair vetted almost 5,000 complaints of alleged Islamophobia; that’s an increase of more than two-thirds compared to the same period the previous year. The volume of incidents was particularly bad in the immediate aftermath of 7 October. In the last three months of 2023, Cair received more than 3,500 complaints, an almost 180% increase in relation to the corresponding months in 2022.

Cair defines Islamophobia as a fear, hatred or prejudice towards Islam or Muslims perpetuated by people and institutions. Many of the incidents in the last year entailed anti-Palestinian censorship and discrimination; Cair says it counts these cases because anti-Muslim and anti-Palestinian bias are often conflated. Experts note that anti-Muslim sentiment has actually its origins in anti-Palestinian discrimination: Arab Americans organizing for Palestine in the 1960s and 70s were spied on by the government and some of the country’s first anti-terrorism laws evolved as a response to Palestinian liberation struggles.

Among the most violent incidents of the last year were the fatal Chicago stabbing of six-year-old Wadea al-Fayoume and a Vermont shooting of three Palestinian college students that left one of them, 21-year-old Hisham Awartani, paralyzed. But far more common is what advocates view as the censorship and discipline of students and employees for being pro-Palestinian.

“Post 9/11 was more of the knee-jerk reaction: your typical bigot inside a grocery store targeting a Muslim hijabi. That’s reactionary, that’s the type of discrimination we were used to,” says Abed Ayoub, national executive director of the Arab American Anti-Discrimination Committee. The targeting of students and employees since 7 October feels systematic, he adds.

Of the almost 5,000 complaints Cair received in the first half of this year, it said 19% were related to immigration and asylum, 14% to employment discrimination, 10% to education discrimination and 8% were hate crimes and similar incidents. Cair says immigration cases – often involving people from Muslim-majority countries facing extra scrutiny – have long been the most common kinds of complaints they get.

What’s new is people being targeted at their schools and workplace “in a personal way that we’ve never seen before”, says Saylor. This can involve, for example, students and employees who get disciplined for social media posts supporting Palestine. Cair views these cases as discriminatory because, the group says, the rules are often enforced inconsistently, with workplaces and schools that send emails supportive of Israel punishing employees with different political opinions.

Palestine Legal, a non-profit that has filed more than a dozen complaints with the education department alleging anti-Palestinian discrimination, says the rules often go out the window when it comes to pro-Palestinian speech. “[Students are] being dragged through disciplinary hearings without any due process. They’re getting suspended before any conclusion has been made in their disciplinary hearing,” says Dima Khalidi, the organization’s founder and director.

Like Cair, Palestine Legal was flooded with cases in the three months following 7 October, when it received more than 1,000 requests in that time. (That’s four times more than the number of requests they received in all of 2022.) Both organizations note their tallies are likely undercounts.

Alongside these incidents, antisemitism has also been rising. FBI data released in September noted that anti-Jewish hate crimes increased by almost two-thirds in 2023, from 1,122 documented incidents to 1,832. It’s not immediately clear how many of those occurred after 7 October. The Anti-Defamation League has also recorded a surge in antisemitic incidents, but its data has been called into question for its conflation of antisemitism with criticism of Israel.

Advocates point to what they say is the normalization of rhetoric conflating Arab Americans with terrorism, a pattern that recalls the post-9/11 environment. Last month, the Republican senator John Kennedy repeatedly suggested, without evidence, that Maya Berry, the head of the Arab American Institute, supported Hamas and said that she should hide her “head in a bag”. The principles set out below result from, reflect and have been elaborated by applying the general principles and legal standards in General Part I and Part II, above, to the criminalization of conduct associated with: a) sexual and reproductive health and rights, including abortion; b) consensual sexual activities, including in such contexts as sex outside marriage, same-sex sexual relations, adolescent sexual activity and sex work; c) gender identity and gender expression; d) HIV non-disclosure, exposure or transmission; e) drug use and the possession of drugs for personal use; and f) homelessness and poverty.

PRINCIPLE 14 – SEXUAL AND REPRODUCTIVE HEALTH AND RIGHTS No one may be held criminally liable for exercising their rights to sexual and reproductive health, such as requesting, accessing or using sexual and reproductive health facilities, services and goods, including information. Criminal law may not in any way impair the right to: a) make and act on decisions about one’s own body, sexuality and reproduction – such as about pregnancy; contraception, including emergency contraception; comprehensive abortion care; prophylaxis for sexually transmitted infections; gender-affirming care/therapy; and/or b) access health facilities, services and goods, including information. No one may be held criminally liable on the basis that their conduct is alleged to be harmful to their own pregnancy, such as alcohol or drug consumption or contracting HIV or transmitting it to the foetus while pregnant, or for their own pregnancy loss. Where the person’s conduct might also constitute an independent criminal offence, unrelated to their pregnancy, there must be no additional criminal consequences arising from any alleged harm to their pregnancy. Health providers may not be held criminally liable for conduct, such as providing contraception, abortion services or accurate, evidence-based, non-biased information, that enables others to freely exercise their rights to sexual and reproductive health, unless they engage in coercion, force, fraud, medical negligence or otherwise violate the right to free and informed decision-making. No one may be held criminally liable for providing assistance to another to enable them to exercise their rights to sexual and reproductive health, unless there is coercion, force, or lack of free and informed decision-making in relation to the exercise of such rights. Parents, guardians, careers, or other persons who enable or assist children or people in their care, including persons with disabilities, to exercise their sexual and reproductive rights, including by procuring sexual and reproductive health services, goods or information, may not be held criminally liable, unless they have engaged in coercion, force, fraud, or there was a lack of free and informed decision-making on the part of the child or person for whom they were caring.

PRINCIPLE 15 – ABORTION No one may be held criminally liable for their pregnancy loss, including a pregnancy loss resulting from an obstetric emergency, such as a miscarriage or stillbirth, or for attempting or undergoing an abortion or for other decisions they make around their pregnancy or childbirth. Criminal law may not proscribe abortion. Abortion must be taken entirely out of the purview of the criminal law, including for having, aiding, assisting with, or providing an abortion, or abortion-related medication or services, or providing evidence based abortion-related information. No other criminal offence, such as murder, manslaughter or any other form of unlawful homicide, may proscribe or be applied to having, aiding, assisting with, or providing an abortion, or abortion-related medication or services, or providing evidence-based abortion-related information.

PRINCIPLE 16 – CONSENSUAL SEXUAL CONDUCT Consensual sexual conduct, irrespective of the type of sexual activity, the sex/ gender, sexual orientation, gender identity or gender expression of the people involved or their marital status, may not be criminalized in any circumstances. Consensual same-sex, as well as consensual different-sex sexual relations, or consensual sexual relations with or between trans, non-binary and other gender diverse people, or outside marriage – whether pre-marital or extramarital – may, therefore, never be criminalized. With respect to the enforcement of criminal law, any prescribed minimum age of consent to sex must be applied in a non-discriminatory manner. Enforcement may not be linked to the sex/gender of participants or age of consent to marriage. Moreover, sexual conduct involving persons below the domestically prescribed minimum age of consent to sex may be consensual in fact, if not in law. In this context, the enforcement of criminal law should reflect the rights and capacity of persons under 18 years of age to make decisions about engaging in consensual sexual conduct and their right to be heard in matters concerning them. Pursuant to their evolving capacities and progressive autonomy, persons under 18 years of age should participate in decisions affecting them, with due regard to their age, maturity and best interests, and with specific attention to non-discrimination guarantees.

PRINCIPLE 17 – SEX WORK The exchange of sexual services between consenting adults for money, goods or services and communication with another about, advertising an offer for, or sharing premises with another for the purpose of exchanging sexual services between consenting adults for money, goods or services, whether in a public or private place, may not be criminalized, absent coercion, force, abuse of authority or fraud. Criminal law may not proscribe the conduct of third parties who, directly or indirectly, for receipt of a financial or material benefit, under fair conditions – without coercion, force, abuse of authority or fraud – facilitate, manage, organize, communicate with another, advertise, provide information about, provide or rent premises for the purpose of the exchange of sexual services between consenting adults for money, goods or services.

PRINCIPLE 18 – SEXUAL ORIENTATION, GENDER IDENTITY AND GENDER EXPRESSION No one may be held criminally liable for conduct or status based on their gender identity or gender expression. This includes gender identities and forms of gender expression that are perceived not to conform to societal expectations or norms relating to gender roles, the sex assigned to a person at birth or a male-female binary, among others. No one may be held criminally liable for consensual practices aiming to assist others with the exploration, free development and/or affirmation of sexual orientation or gender identity, unless there was force, coercion, fraud or medical negligence, or a lack of free and informed decision-making on the part of the person concerned. Practices aiming to change or suppress a person’s sexual orientation, gender identity or gender expression carried out without the concerned person’s free and informed consent and decision-making, including through force, coercion or abuse of authority, may be addressed through other provisions in the criminal law.
