Huge Victory For Texas As Supreme Court Declines To Hear Arguments In Emergency Abortion Case

The Supreme Court handed the state of Texas a huge victory after deciding not the hear arguments in a case that focused the Emergency Medical Treatment and Labor Act (EMTALA) – that was invoked after Roe V. Wade was overturned.
The Act requires federally funded hospitals to provide stabilizing care to emergency room patients no matter their ability to pay, but says nothing about providing abortions.
The case could have made clear the line between state abortion laws and the federal emergency care law, but would have forced hospitals and doctors to violate state law and provide abortions.
Texas sued the Biden-Harris Administration shortly after the guidance was issued, saying they didn’t properly apply the law, and didn’t follow the correct rule making process.
A lower court ruled in favor of Texas, and the U.S. Court of Appeals for the 5th Circuit agreed.
