The ISF or Importer Security Filing is a requirement imposed by US Customs and Border Protection (CBP) that applies to all shipments being imported into the United States. The purpose of ISF is to enhance supply chain security and allow CBP to assess any risks associated with incoming cargo. There are two key ISF filing deadlines - the ISF 10+2 and the ISF 5+2. The ISF 10+2 deadline requires the filing of ten data elements by the importer or their authorized agent, as well as two additional data elements provided by the carrier, at least 24 hours before the vessel's departure to the United States. This deadline allows CBP to perform risk assessments on shipments before they arrive. The ISF 5+2 deadline applies to shipments arriving by other modes of transportation and requires the importers or their agent to file five data elements at least 24 hours before the cargo is loaded onto the aircraft or truck, and then provide the remaining two data elements within 24 hours after the cargo has departed. Non-compliance with ISF filing deadlines can result in penalties imposed by CBP, which can be significant. For example, the penalty for the initial ISF violation can be as high as $5,000, and subsequent violations may result in penalties up to $10,000 per violation. To avoid penalties and ensure compliance, it is recommended to work with an experienced customs broker who specializes in ISF filings. Customs bonds are also important in the context of ISF filings, as CBP requires the customs bond to be in place before an ISF filing is accepted. Partnering with a customs broker who can assist in obtaining a customs bond is essential for a smooth and compliant import process. Overall, understanding ISF filing deadlines and penalties is crucial for importers and customs brokers involved in international trade to ensure a secure and efficient supply chain.
