The responsibility of filing the ISF lies with the "Importer of Record" or their authorized agent, often a licensed customs broker. The "Importer of Record" is the party responsible for the payment of duties and taxes associated with the imported goods and has the contractual relationship with the seller or supplier outside of the United States. However, the "Importer of Record" may designate a customs broker or freight forwarder as their agent for ISF purposes. It's important to note that for ISF filing, the "Importer of Record" or their agent must have a valid Customs Bond, which serves as a financial guarantee to CBP.

The eligible entities for ISF filing include importers, who are responsible for filing the ISF themselves or through their customs broker, non-vessel operating common carriers (NVOCCs) or vessel-operating common carriers (VOCCs) who can handle the ISF filing on behalf of the importer, and customs brokers who have the expertise and knowledge of customs regulations and procedures to ensure accurate and timely submissions. Regardless of who files the ISF, the responsibility for the accuracy and completeness of the information rests with the filer.

Non-compliance with ISF requirements can result in penalties and delays in the clearance of goods, so it is crucial for all parties involved in the import transaction to work together and ensure compliance with ISF regulations. The smooth flow of goods through the customs process relies on the cooperation and expertise of these eligible entities.
