Company structure
Nius went online at the beginning of July 2023. Julian Reichelt thus continued his work, which he had begun at the Bild newspaper and the associated station.
Initially, individual formats were introduced, for which there are social media accounts such as YouTube, X, Facebook and Instagram in addition to the websites, each under the same name. The formats were bundled under the Nius brand. The stories are distributed on the portal both as text and as video. The different formats are called "shows".

Am 16. April 2024 startete die einstündige Morgen-Newssendung „NIUS live“. Sie erreichte im Juni 2024 Platz 1 auf den Podcast-Charts von Spotify.
Erster Chefredakteur von Juni bis Oktober 2023 war Jan David Sutthoff.[7][8][9][10] Ihm folgten gemeinsam die ehemaligen Bild-Journalisten Sebastian Vorbach und Willi Haentjes.[11] Zur 30-köpfigen Redaktion gehören die ehemaligen Bild-Redakteure Ralf Schuler, Julius Böhm, Zara Riffler[12] und Alexander Möhnle,[13] die zuvor bereits mit Reichelt gearbeitet hatten,[14][15] sowie Judith Sevinç Basad (zuvor pleiteticker.de),[16] Louis Hagen,[17] Jan Aleksander Karon,[18] Christian Kemper,[19] Amir Makatov,[20] Anabel Schunke[21], Giovanna Winterfeldt[22][23] und Rob Szymoniak.[24]
Finanziert und kontrolliert[7] wird das Angebot von dem Medienunternehmer Frank Gotthardt, der als Förderer Reichelts nach dessen Karriereende beim Springer-Verlag bekannt wurde.[25][8] Gotthardt erklärte seine Motivation für die Zusammenarbeit mit Julian Reichelt damit, dass es in Deutschland eine „Übermacht der Medien [gebe], die links zu verorten sind“. Die Gründung von Nius sei daher seiner Meinung nach „staatsbürgerliche Verantwortung“. Das Portal werde nur als rechts der Mitte wahrgenommen, weil die Mitte „nach links gedriftet“ sei.[26][27] Als Herausgeber fungiert Gotthardts Firma Vius SE & Co. KGaA.[28] Sitz von Redaktion und Herausgeber ist Berlin.
Kontroversen
Nius unterwirft sich nicht den Bestimmungen des Pressekodex. Für kommerzielle Angebote mit journalistischem Inhalt wie Nius ist nach dem Medienstaatsvertrag die Medienanstalt Berlin-Brandenburg zuständig. Diese kann die Inhalte auf die Einhaltung journalistischer Mindeststandards überprüfen und hat Nius wegen Beschwerden im Blick. Nius macht sich nach Ansicht von Felix W. Zimmermann von der Legal Tribune Online die Rechtsprechung gezielt zunutze, die davon ausgeht, dass der durchschnittliche Leser nicht nur Überschriften, sondern den gesamten Artikel liest, was heute nicht mehr unbedingt lebensnah ist. Mit irreführenden und skandalisierenden Überschriften wolle Nius Aufmerksamkeit um jeden Preis erzielen. Erst im Text würden irreführende Eindrücke aus Überschrift und Teaser wieder zurechtgerückt.[29]
Klimawandel
Im Juli 2023 wurde auf Nius den im Mittel global steigenden Temperaturen das in Deutschland von Niederschlägen geprägte Wetter gegenübergestellt und daraus eine „Diskrepanz“ abgeleitet.[30] Als Klimaexperten präsentierte Nius Fritz Vahrenholt, der die Meinung vertrat, die Berichterstattung zum Klimawandel diene dazu, Angst und Panik zu verbreiten. Die Folgen der globalen Erwärmung würden übertrieben. René Orth, Wissenschaftler am Max-Planck-Institut für Biogeochemie, und Johann Jungclaus, Forscher am Max-Planck-Institut für Meteorologie, sagten dazu, eine Zunahme von Hitzewellen oder Starkregenereignissen sei in vielen Gegenden der Welt klar belegt und auch im Weltklimabericht abgebildet. Dieser stütze in „keinster Weise“ Vahrenholts Behauptungen.[30]
Im Juli 2023 berichtete Nius von der „heißeste[n] Klimalüge des Jahres“. „Nahezu alle Medien im Land und die Bundesregierung“ hätten hinsichtlich der Tageswerte für Italien bzw. Südeuropa falsch berichtet. Anders als bei Nius behauptet, wurde in der Berichterstattung jedoch über die vorhergesagten Temperaturen und nicht die tatsächlich gemessenen Werte vor Ort gesprochen. Nius behauptete ferner, in der Berichterstattung sei die Bodentemperatur mit der Lufttemperatur verwechselt worden, irrte aber auch in diesem Punkt: In einem zugrunde liegendem Bericht der ESA entstand zunächst der Eindruck, dass die Bodentemperatur gemeint sei. Der Bericht bezog sich jedoch auf die Lufttemperaturen.[31]
In einem Artikel auf Nius wurde der ZDF-Meteorologe Özden Terli angegriffen und ihm ein „Absolutheitsanspruch“ vorgeworfen. Es werde „keinerlei Raum“ für eine „demokratische Debatte“ gelassen. Terli sagte in einem Tweet als Reaktion unter anderem: „Ich hätte nie gedacht, dass der Zug in eine derart wissenschaftsfeindliche Richtung fahren würde.“[32]
Asylbewerber
After CDU chairman Friedrich Merz's claim at the end of September 2023 about dental services for rejected asylum seekers, which would make Germans wait a long time for dental appointments,[33] Nius produced a report on the topic with refugees who spoke little or no German. [34] The article had the tenor that asylum seekers made excessive use of dental treatment in Germany.
The NDR media magazine Zapp visited the refugee shelter, in front of which Nius reporter had apparently addressed the exclusively male interview partners. Those affected reported, among other things, that they had been asked by the Nius reporters to show their teeth and raise their thumbs. The director of the dormitory said, "Basically, people were abused. […] Their words were turned around in their mouths." The fact that they themselves had made a co-payment for dental treatment, for example, was not mentioned in the article. In addition, Nius did not address the fact that Merz had spoken exclusively of rejected asylum seekers. [35]
Termination of Jan Fleischhauer's contract
Jan Fleischhauer, who was originally supposed to host a late-night show called Fleischhauer's World from September 2023,[7] terminated his contract. [36][37] The reasons given were that the website was "[s]very dark, very aggressive" and did not live up to the claim "voice of the majority". Furthermore, Reichelt dominates the company more than he was assured when the contract was signed. In Fleischhauer's view, people "don't want to be yelled at or shaken up all the time". [38]
Alexandra Föderl-Schmid
Nius played a decisive role in a controversy surrounding the deputy editor-in-chief of the Süddeutsche Zeitung, Alexandra Föderl-Schmid, at the beginning of 2024. Nius commissioned the communication scientist Stefan Weber to check the plagiarism of her dissertation. [39][40] The fact that Nius Weber paid for his research raised questions in the media industry about the motivation of the portal. [41][39][42][43]
Examination by the media supervisory authority
In February 2024, it became known that the Berlin-Brandenburg Media Authority (MaBB) was examining whether supervisory proceedings against Nius need to be initiated. Previously, several complaints had been received by the authority. The audit is solely about the question of whether journalistic due diligence obligations are complied with, t-online quoted MaBB legal advisor Marco Holtz. The political orientation of the offer is irrelevant for the review under media law. [44]
Reichelt's successful appeal to the Federal Constitutional Court
On April 11, 2024, the Federal Constitutional Court upheld a constitutional complaint by Julian Reichelt against a decision of the Berlin Court of Appeal. At the request of the Ministry of Development Aid, the court had prohibited a formulation in a post by Reichelt on X, which dealt with aid funds for Afghanistan and, in the opinion of the Court of Appeal, assumed financial support for the Taliban. Contrary to the opinion of the Court of Appeal, this post was not to be assessed as a factual allegation, but as an expression of opinion as a whole. In its reasoning, the chamber of the Federal Constitutional Court focused primarily on the fact that Reichelt linked to an article by Nius, in which it was correctly stated that the development aid did not go to the Taliban government, but to other organizations active in Afghanistan.
"In principle, the state must also endure sharp and polemical criticism," writes the Federal Constitutional Court Chamber in its unanimous decision. "The meaning and scope of freedom of expression are misjudged if the courts incorrectly classify a statement as a statement of fact, formal insult or abusive criticism in the constitutional sense." [45][46][47]
Injunction of the Anti-Discrimination Agency was rejected
After Nius reported on the work of the Anti-Discrimination Agency with untruthful headlines such as "Government wants 1000 euros fine for women's gym because it doesn't want to let a man in the shower" and "Women who don't want to shower with men should pay a fine", the ADS demanded that the operator, the commercial platform, VIUS SE & Co. KGaA, financed by Frank Gotthardt, Omission. It would simply be fake news. In the summer of 2024, the Anti-Discrimination Agency (ADS) was defeated in the first instance at the Berlin Regional Court and in the second instance at the Court of Appeal. According to Felix W. Zimmermann of Legal Tribune Online, the background to this is that traditional case law assumes that the average reader reads not only headlines and teasers, but the entire article, which is not necessarily true-to-life and allows portals to attract attention with misleading and scandalizing headlines. According to the judge's ruling, there was not even a rudimentary "impairment of the functioning of the state" that allowed an encroachment on the special need for protection of the criticism of power against the state, and so the prerequisites for preventing such "expressions of opinion" were missing. Ataman said on behalf of the ADS after the verdict that she "finds it questionable that inaccurate, scandalous allegations can be spread. We will review the decision and remain convinced of our legal position." [48][49]
Various proceedings in court
Nius and Julian Reichelt were banned by the Hamburg Regional Court in April 2024 with a temporary injunction to give the impression that the PolizeiGrün association was working for the Bündnis 90/Die Grünen party. Other statements challenged by the Greens, on the other hand, were considered admissible by the court. The two parties each bore about half of the costs of the proceedings. [50][51] In October 2023, the same court had issued a preliminary injunction against Nius and Reichelt for inadmissible reporting of suspicions and falsehoods. In the context of the BSI affair, Nius had suggested that Nancy Faeser could be behind the report of the ZDF Magazin Royale, which had set the affair in motion. In addition, the court considered the statement to be untrue, the ZDF report contained "not a single true accusation". [52][53] Due to a failure to comply with another preliminary injunction in the Nius/Reichelt case against the sea rescue organization Mission Lifeline from November 2023, the Berlin Regional Court imposed a penalty payment in March 2024. [54]
Reception
In mid-July 2023, the taz accused the portal of "right-wing populist propaganda" and a distortion of facts. [2]
At the end of July 2023, the Frankfurter Rundschau saw parallels between Nius and the US broadcaster Fox News, also owned by a billionaire (Rupert Murdoch). "Voices from the media industry" would insinuate Nius that "it would spark culture wars to distract from class struggles." [5]
The media journalist Stefan Niggemeier wrote in reference to Nius that it consists of "abysses of hatred and spite, distortions and slander, manipulation and delusion". [35]
On July 16, 2023, the queerappointed by the Berlin Senate Administration, Alfonso Pantisano, filed a complaint against Reichelt and Basad on charges of incitement to hatred. [55] Pantisano refers to Reichelt's criticism of an action by the Berlin police with a rainbow flag expressed via Twitter and to a video of Basad published by Nius entitled Trans ist Trend: How an ideology changes our country. Shortly afterwards, the Berlin police confirmed the initial suspicion of the crimes and initiated investigations. [55]
Political scientist Markus Linden sees Nius' offer as a "right-wing populist agitationformat with a journalistic touch". The portal pursues a double strategy: on the one hand, "moderate" formats with democratic politicians, on the other hand, "sensationalist riot formats in which there is no visible connection to journalistic due diligence". The Nius makers are media professionals, but they follow an agenda. The portal is "a central media mouthpiece of the circles around Hans-Georg Maaßen," said Linden; Nius is "Union of Values TV". [56]
