Who can avail themselves of the Insanity Defense?

At the time of the crime, if the defendant is mentally ill, they may be excused from legal responsibilities. The state will not punish those who are not morally responsible.
M'Naughten Test - If, as a result of a mental illness or defect, the defendant did not know that his act was wrong nor did they understand the nature and quality of their acts, the defendant may escape liability for their act.
Durham Test - Because of a mental disease or defect, the defendant is incapable of being guilty of a crime.
Irresistible Impulse Test - If the defendant, because of a mental disease or defect, acted out of an inability to control their actions or conform their actions to the law, the defendant will not be guilty of the crime.
MPC Test - As a result of a mental defect or disease, the defendant lacks the substantial capacity to appreciate the wrongfulness of their actions or to conform their conduct to the requirements of the law.
