The ISF is a mandatory requirement that provides advance information about the cargo to US Customs and Border Protection (CBP) to enhance security and facilitate screening. If theft or loss occurs despite the ISF being filed, the importer or their customs broker should immediately notify the CBP and provide relevant details. It is important to determine if a customs bond is in place, as it can provide some protection, although not necessarily covering the full value of the lost cargo. The importer or their customs broker should work closely with the CBP to investigate the incident, providing detailed information and supporting documentation. If the theft or loss is confirmed, the importer or their insurance company may pursue a claim for reimbursement, emphasizing the importance of obtaining cargo insurance. The ISF filing primarily serves security and compliance purposes, and while it facilitates customs clearance, it does not specifically cover instances of theft or loss. Importers should prioritize notifying the CBP, cooperating in the investigation, and considering claims with insurance companies. Customs bonds and cargo insurance are essential tools for importers to mitigate potential losses.
