The case centers on Idaho's near-total abortion ban and its clash with the federal EMTALA statute. Justice Ketanji Brown Jackson's scathing dissent highlights the court's failure to protect women's health, slamming the decision as “political chicanery before the election.” The decision comes on the heels of a study revealing a 13% spike in Texas' infant mortality rate following the enactment of its abortion ban. “We are the most dangerous place in all of the industrialized world to be pregnant or for infants to be born,” says Michele Goodwin, a professor of constitutional law & global health policy at Georgetown Law.
