Posted • June 27, 2024: Today was another opinion day and while there were no absolute blockbusters, we still think that SEC v. Jarkesy is worth paying attention to—especially for the telling reaction on the left. The issue is whether or not the SEC (the Securities and Exchange Commission) can impose civil penalties for alleged securities fraud without a civil trial before a jury in federal court, as guaranteed by the Seventh Amendment.
