The lawsuit seeks civil monetary penalties, damages, and injunctive relief from Pfizer's misleading and deceptive statements made in marketing its COVID-19 vaccine. Kobach also alleges that Pfizer violated consent judgments it previously entered into with Kansas and other states to settle separate allegations.
Kobach has stated that he believes Pfizer's actions were "unacceptable" and that the company's claims about its vaccine were "misleading and deceptive." He also stated that he is seeking to hold Pfizer accountable for its actions and to protect the public from further harm.
Kobach has stated that he expects five other states to join the lawsuit. The case is filed in Thomas County, Kansas, and Kobach has stated that he chose to file the lawsuit in that county because of its lighter workload, allowing his office to devote the necessary resources to the case.
