NYC subway rider who shot ‘aggressive’ passenger during rush-hour commute won’t be charged

Prosecutors announced on Friday that the Brooklyn commuter who shot a man attacking him on a rush-hour train will not face charges.

This decision comes as new footage emerged showing the gunman’s apprehension on the station stairs.

“Yesterday’s shooting inside a crowded subway car was shocking and deeply upsetting,’’ said Oren Yaniv, a spokesman for the Brooklyn District Attorney’s Office, in an e-mailed statement.

“The investigation into this tragic incident is ongoing but, at this stage, evidence of self-defense precludes us from filing any criminal charges against the shooter,” the New York Post reported.
