Day 4. Closing Arguments. All sides presenting their reasons for granting/denying the motion to disqualify Willis and Wade based upon Georgia law and evidence presented.

WHAT TO EXPECT:
In addition to closing arguments, we will likely get a determination about admissibility of evidence including phone records with geofencing that strongly indicates that Willis/Wade romance commenced months earlier than they claimed on the stand and prior to Wade being hired.

ISSUES OF FACT TO BE DETERMINED:
The nature of the Willis-Wade Relationship;
When if ever it became romantic;
The nature of shared expenses;
The amount of compensation given to Wade; and
Other matters as they become relevant.

WHAT HAPPENED SO FAR:
Fani's friend testified that Fani told her about the relationship in late 2019 early 2020 (nearly 2 years before Wade was hired).

Wade and Fani both testified that the relationship began in March-April 2022 and that Fani paid back her share of expenses "in cash."

Gov. Roy Barnes testified that Fani offered him the Special Prosecutor's job on October 26, 2021 (5 days before Wade was hired), but he declined. Oddly, Wade, though having no position in the District Attorney's office, was present at the meeting.

Fani's father took the stand and corroborated timeline of Fani moving out of her home and claims about teaching Fani to horde cash. Then he admitted that he was prepped with Fani and watched her testimony despite the Court directing the State to direct their potential witnesses to sequester themselves. SERIOUS BLOW to the State as to his own credibility and even Fani's credibility.

Terrance Bradley, Wades friend/former partner/divorce lawyer, testified with repeated objections of privilege from his counsel. Defense drew out possible inferences that Bradley knew that Wade lied in his testimony about timing of the Wade-Willis relationship but hid behind an empty claim of "attorney client privilege." The State crossed him by alleging that his relationship with Wade ended because of allegations of improper sexual conduct with women around the office.

YESTERDAY, Judge MacAfee conducted an "in camera" discussion (behind closed doors with Wade's former partner/divorce lawyer, to assess whether he wrongly claimed privilege when no privilege applied under Georgia law. After that meeting, MacAfee ruled that privilege doe NOT cover all communications between Bradley and Wade that relate to Fani and that Defense may question him on that topic.

BACKGROUND: Michael Roman is Donald Trump's Co-Defendant in the Georgia RICO action filed by District Attorney Fani Willis and Special Prosecutor Nathan Wade. Roman filed a motion to remove Willis, Wade and their respective offices based on allegations that they have a conflict of interest. Specifically, Roman alleged that: i) Willis and Wade have a personal romantic relationship; and ii) Willis was motivated to retain Wade and prosecute Roman to enrich herself and/or her boyfriend.

In a sworn affidavit, Wade admitted to the personal relationship, however he alleges that the relationship commenced after he was retained by the Willis and Fulton County.

The Defense counters that they have witnesses (and potentially previously filed Wade affidavits) that refute Wade's sworn testimony.

The Court has agreed to conduct a 2 day evidentiary hearing to determine whether Roman and Trump (who has joined in the motion) have a legal basis to remove Fani and her office.

SIDE WRINKLE: Wade was married when he was retained as Special Prosecutor and filed for divorce the next day. Was the divorce compensation for retention by Willis/Fulton County? What evidence has defense unveiled courtesy of Divorce proceedings?
