This falls under the "Kidnapping" code in the SDCL
22-19-17. False imprisonment--Misdemeanor.
Any person who knowingly and purposely restrains another person unlawfully so as to substantially interfere with such person's liberty is guilty of false imprisonment. False imprisonment is a Class 1 misdemeanor.

1. It has now been 29 days since last I saw my Mother (4 Weeks)
2. Black Hills Advocate, a 3rd party guardian and conservator, and my only brother Roger Flyte had my mom vaccinated against My wishes, with the flu and pneumonia vaccine
3. I have cared for my mom for 25 years, and live with my mom for c. 15 yrs.
4. My mom got Pneumonia, which we haven’t had her diagnosed with that in 20 years, or at all
5. She also had an elevated D Dimer of 1300, which is micro clotting
6. Black Hills Advocate won’t let me see my Mom, despite state law
7. I went to pick up my mom from the hospital, and was told I coulnd’t take my mom to our home, my mom’s home of 60 yrs.
8. Black Hills Advocate also cancelled my moms holistic MD and my mom’s addditonal integrative Functional Med Doctor
9. And put her with a Nurse Practitioner on a medicare program
10. I filed an affidavit with Fall River States Attorney Lance Russell and Fall River Sheriff Office Sheriff Lyle NOrton
How did it come to this?
1. In 2022 My Brother moved back to South Dakota to live with us on the family ranch.
2. He had gambling and financial issues, and got divorced.
3. He choked my son and was charged with assault, but plead down to disorderly conduct
4. I filed for Guardianship of my mother, because she has dementia, in order to evict my brother and protect my family
5. My son also got a protection order
6. My brother committed perjury in the protection order by lying about guns, and turned this into the state with full evidence, but was not prosecuted at this time
7. My ex husband Jay also lives with me, and I provide care for him. He too has dementia. There are doctors’ notes for both my mom, Gerda, and Jay
8. My brother had tried to accuse Matthew of abusing my mom and Jay Monfore, but he and myself were exonerated of by Protective services
9. An attorney was appointed by Judge Connolly to investigate myself and Matthew, for the Guardianship case. His name is Elliott Bloom
10. He found no wrongdoing on our part, but said we could improve some of the management of the property.
11. Despite the favorable investigations. Judge Connolly moved my mom to the 3rd Party Guardianship and here we are.
11. He had clear religious and political bias, calling my son’s activities homophobic, hateful, extreme, etc.
Where do we go?
12. Need to get the word out so they can’t do this in the “dark”
13. We have filed for the removal of Black hills Advocate
14. We are appealing this case to the Supreme Court in SD, the only court for Appeal for this case.
