If you are battling COVID related charges in the courts doing self-representation these monthly Zooms are a great starting point.

In this Zoom we focused on addressing the lack of inherent jurisdiction in the provincial courts; the provincial courts were created to implement the United Nations International Court of Justice through statute such as the Ontario Court of Justice. The provincial courts are statutory creatures in that they were born from statute, the legislation created the court and the actors of that court. The jurisdiction of these courts comes from statute only. This means that it is not possible to argue your rights in the provincial court as it does not have the jurisdiction to adjudicate on rights issues, it’s out of their scope.

To tackle this issue, we have crafted a motion for particulars, and what this means is that this is an application to the court compelling the Crown to provide information (particulars). This motion has become a work in progress as we are digging deeper into the issues with PHAC and the orders under the Quarantine Act.
