Ep95 N8 Fri 24th Nov 23 We Can Hold Their Feet To The Fire!!
We have a new coalition Govt. They have made quite a number of good changes that gives some positivity to 2024
Liz reviews these promises and reminds us that we need to hold their feet to the fire continuously!!!
A great Friday must watch
TIMELINE
1 – 00:00:00 – Discussion on politics and the law, noting that while politics can go so far, it's up to the courts to enact change when things go wrong.
- The new coalition agreement between National, ACT and NZ First includes many promises that address issues people have been upset about, like mandates and the sexuality curriculum.
- Key policies and plans supported include scrapping the foreign buyers tax, tax cuts, removing references to sexuality from the school curriculum, reducing the public service, and ending COVID mandates and launching an inquiry.
- Treaty Principal Bill
- NZ First got commitments for $1.2B for regional infrastructure and amending the Waitangi Tribunal's scope to refocus on the Treaty's original intent.
- Analysis of how these new policies could impact unions and workers' rights going forward, as well as the ability to challenge government decisions through the courts using tools like the Bill of Rights Ac, Human Rights Act, Section 5 of the Imperial Laws Application Act and Article 3 of the Treaty of Waitangi.
- Optimism that many issues people have fought against may now be addressed under the new coalition agreement. See https://www.rnz.co.nz/news/political/503153/coalition-details-at-a-glance-what-you-need-to-know?fbclid=IwAR0PVmvL9tBnfCRb5yYIL-zMUVnJ5kjBKLZ34KdtcZ549jxqdX7aQAMW2Xs
2 – 00:13:50 – The new government will apply a national interest test before accepting any UN agreements and confirm that domestic law takes primacy over international obligations.
- While this is just the beginning, the Union can help ensure promises are kept through court cases and submissions.
- Changes discussed include switching the free university fees from first to final year, increased penalties for underage tobacco sales, and reintroducing charter schools.
Nicotine and “covid”.
- Other policies cover daily reading/writing/math hours in schools, legislating English as the official language, stopping work on hate speech laws and emissions trading reviews.
- Confirmation that the UN Declaration of Rights of Indigenous People has no binding legal effect in New Zealand.
- Strengthening the grocery commission aims to increase competition beyond the two major players.
- Superannuation will stay at 65, retirement village legislation will be reviewed, and the super gold card may upgrade home care support.
- Upcoming public inquiries into COVID responses and an independent investigation are seen as ways to enact accountability.
- Union update on cases, PG’s and breach of contract.
3 – 00:29:30 – Judith Collins being appointed Defence Minister and potentially Attorney General under the new government.
- Collins didn't have a role in the 2020 lockdown legislation, so has "clean hands" regarding COVID response laws.
- Lockdown orders were regulations not debated in Parliament due to being state-of-emergency measures.
- The deals for vaccination were to end zero-COVID and move to containment while pushing vaccines on everyone.
- Having lawyers like Collins in roles provides opportunities through Court cases and submissions.
- A previous discussion analysed the NZDF's influence over borders, exemptions and restrictions. See Ep.
- Recent court cases mean councils can no longer be fined for removing fluoride from water.
- Some comments expressed hope the new Christchurch Council would remove fluoride from the water supply.
- Anti-fluoride advocate MARY BYRNE was mentioned who speaks out about risks of fluoridation.
- Discussion reviewing the findings of the Christchurch mosque shootings coroner.
- The Select Committee process for new laws was discussed as an avenue for public input.
- Recent Bassett/Brash/Hide - Peter Williams article commentary was referenced.
4 – 00:50:03 – Keeping up pressure and work on ongoing legal cases despite new opportunities under the new government.
- Someone saw a TV interview where a woman, possibly the chief censor, did not want to censor certain sexual material meant for older children in schools. Parents had expressed concerns.
- It's important to be vigilant about such issues and materials in schools now that change seems possible under the new government.
- Submissions should advocate teaching New Zealanders about the Treaty and constitution in schools to increase literacy about how government works.
- Analysing New Zealand's history around the 1688 English Bill of Rights and constitutional foundations stemming from the English Civil War period in the 1600s.
- Website shared to research acts and ordinances from the Interregnum period when this history was established before being "legally forgotten."
- The importance of not forgetting this founding radical constitutional history was emphasized as Americans seem to better understand their own constitutional origins.
